PPI Reclaiming discussion Part III

Yes di, they sent me a PPI questionnaire, which I refused to fill in, I sent it back to them on Monday stating I refused to fill it in, today I've received the final reply.
I find it hard to believe they've conducted an enquiry, I believe this is a standard response.
The difficulty being, because the PPI box was ticked and signed, how do I prove it was mis-sold, looking at the application form, it looks like I've requested the PPI.
I would take this to the FOS and let them investigate this for you, I think the FOS aware aware on how these companies try to get out of these matters and are used to seeing the same standard fob off response.
When you complete this form, not sure if I have said this to you before hun, but after you have completed, take some photocopies, one for yourself, obviously one for the FOS with copies of correspondence, and also send one to the company and tell them you are now complaining to the FOS for them to investigate this further, and tell them you enclose a copy of the complaint form for their interest and records, sometimes they can still change their minds, if so and it turned out to be successful, just let the FOS know.;)The one and only "Dizzy Di"0 -

I'm sorry if this has already been covered but I'm not going to read through 585 pages of posts to find out.
A+L as you know have been fined by the FSA for mis-selling PPI. As a result they now have a dedicated team working on sorting out refunds. They will be writing to everyone who took out PPI between 14/01/05 and 31/12/07 but this will take a while. They already have a backlog of complaints to look into which have been generated either by people writing in following the FSA's fine or from initial mail outs to customers. Detailed guidance about how to deal with complaints has only just received and put into action, hence the initial backlog.
Lastly please don't think that you need to take on a claims handling company to get any potential refund. A+L will write to everyone who took PPI within the selected period without you having to engage a third party and paying them a % for doing sweet f.a.0 -
Dont have the agreement, i have had the card for years.
Have you requested a Subject Access Request (SAR) from them hun?
Mine was taken out in 2001 and I was lucky to receive everything as from that date when this was requested in 2008, even though they only generally go as far back as 6 years with supplying the information. The one and only "Dizzy Di"0 -
Hi
It could be that they are stalling, or maybe they are looking into this further.
Hopefully though hun, it may be a good thing as they have kept you uptodate within 4 weeks as it seems, so fingers crossed hun X
Did they not suggest the Financial ombudsman at this stage as an option for you hun?
Their middle paragraph stated:
"As previoulsy stated our regulator, the Financial Services Authority, requires that if we are unable to resolve your complaint to your satisfaction within eight weeks of receipt, we must contact you again and explain why. You can then (or sooner if you do not accept our earlier resolution) exercise your right to take your complaint to the Financial Ombudsman Service. You will then have six months from the date of our final response to do this"
So my interpretation is they are NOT suggesting AT THIS STAGE that the Financial Ombudsman Service is an option, but if they go beyond the eight weeks (or if they come to a conclusion within the eight weeks that I am not happy with) then the Financial Ombudsman is an option.0 -
When you complete this form
Will do di, do you have a template letter I could use for my FOS complaint please?Click here for Martins (MSE) advice on who to contact with Debt Issues - YOU HAVE NO REASON TO USE A FEE PAYING DEBT MANAGEMENT COMPANY- THEY CANNOT DO ANYMORE FOR YOU THAN THOSE LISTED IN MY LINK ABOVE.
All information given by myself is offered informally and without prejudice - if in doubt seek help from a qualified and insured professional0 -
The letter goes onto to say:
The salesperson recommended PPI for the following reasons:
For simple peace of mind that your payments are being made
You had no cover in place to meet loan repayments.
That's not true, I get paid work or play by my employer if I'm off sick, I still receive a full salary so the payments would have been met.
When you send your form to the FOS, as you know you should write that in to about the employer, this will or should help in your favour as well.;)The one and only "Dizzy Di"0 -

Right okay, well keep a check like you've been doing on the timescale they have, I hope it goes in your favour, good luck.;)
If you still do not hear anything by then, you are entitled then just to go forward to the FOS to complain.
If you let us know, we shall take it from there, cheers. XThe one and only "Dizzy Di"0 -
