  • AS IF TO TEMPT FATE......

Just received the 'tough, you're not getting your money back......' letter from Egg!!!!

"I have spoken to the St Andrews Claims Department who have confirmed you would not have been able to claim for the condition detailed in your letter. However, you could have potentially made a successful claim under a different section of the policy.

As the policy was taken online with no sales person involved, I am sorry to inform you that my decision remains the same and I cannot uphold your complaint".

And no mention of refunding the £17.50 in fees it cost me to get my GP to give me that letter!

I'll be spending the day writing my court claim out. In their words, "YOU WOULD NOT HAVE BEEN ABLE TO MAKE A CLAIM". Clearly if the illness was suffered for the length of time detailed in my letter, it's pretty clear what the most likely cause of any claim would be, isn't it? Oh well, I've not had a good court claim in for a while. And once I've done this, I'll be making the FSA aware of this particularly given the recent decision against Egg. All for the sake of a grand.
Almost debt-free, but certainly even with the Banks!

  • Do you mean in terms of my household legal protection?

I'm certainly happy to submit the court papers as I've taken another bank to court over this issue (they settled eventually!), but definitely feel this is not the end of the matter as far as Egg go.

I'm pretty sure the FOS option that Egg have put at the end of their letter is now pretty much a 'no go' given that the policy was taken out in June 01. Is this correct?

I know. Particularly when they have acknowledged the 'you would not have been able to submit a claim' bit  What numpties! I'm probably even more hacked off with £17.50 part for the GP's fees at the moment  I can think of soooooo many 4 letter words to call them right now, and each of them would upset my Mum.

I think I'll ask them to quantify the 'potentially' bit for submission with my court papers. Better dig out my old template and dust off the boxing gloves.

Thanks Boo, can't believe it. The SARS also shows that they added ppi to a loan without premission the box is clearly unticked. Will help them with their investigation by sending them the offending paper work.

Query: If I have signed a direct debit form for a set amount of money and they take a different amount can I threaten them with anything?

the solicitor takes out insurance for payment if he/she loses, but if they win they claim off company.
  • No win no fee? I'm not too sure how I feel about those companies. General advice appears to be to avoid them. Do the offer guarantees about your credit record and things afterwards?

    What about the FOS option?
