My husband was sold PPI as part of his car loan. the car company wrote to him asking if he felt he was mis-sold, and gave examples that this may have been the case if he received sick pay or had savings. He yes to both of these but when we got a response to their investigation, it said that their paperwork showed that they still considered him to need PPI and that, in any case, he had a 30 day cooling off period in which to cancel it, and were therefore not going to refund his money. this seems to be a cop out to me - if they were just going to say he could have cancelled in 30 days, then why offer to investigate and refund in the first place? Does the 30 day cooling off period negate the ability to cliam that you have been mis-sold? We will be taking this to the ombudsman but would welcome some views on the company's respnse.

    Hi there

Who sold the finance? (company etc)
It does not matter where the 30 days comes into this, it makes no difference.

So I take it this is the first response you received from the company?

They do tend to fob off at first stages, but you should be able to write back to them if they have given you this opportunity, or if they have already mentioned the FOS I would consider that now as well.;)

  • Welcome Big Dog!!! Really enjoyed what you've been saying - may have to get you to review some of my cases against Sainsbury and (Rotten) Egg. Particulalry given that these agreements are from well before the date you mentioned.

But what is going on in here?! From what I saw, no one on here should have fell out with anyone. I felt Marshallka going is a big loss to the forum as she's clearly got a lot of knowledge and I don't think there's any negative sentiment on here at all towards her. There were clearly some things going on which I knew nothing of - even as a daily reader of the forum - however, if Marshallka felt as if she didn't get enough support on here, I'm sorry, but that's really not how I saw it. She clearly wanted more people to respond to CC in the tone she had taken, but that's not the way of a lot of people. I thought CC started off as coming across as quite rude (apologies!) but then gave some really useful advice which helped some people out. At that point, it all should have been forgotten with, but it wasn't. I take the attitude, you have your argument, you say what you need to say, and then you move on and forget about it. If Marshallka felt she couldn't do that, then I'm sorry she felt she had to leave as I always looked forward to her posts, and I always welcomed and learned from her advice.

I was one of those people who has been quite clear of their support of Marshallka on here, however, and I would hate to think she's cutting off her nose (or the nose of fellow reclaimers) purely because she didn't feel as if she had enough support. I certainly came on here and largely ignored any tensions between Marshallka and CC in an effort to try and see these issues fall down the forum list so that we could all move on. If that was deemed to be a lack of support then it certainly wasn't as I even PMed her to ask her to stay on here and ignore whatever she felt about CC to continue to help reclaimers. Something thereafter appears to have happened and what was nothing more than a disagreement seems to have just went downhill from thereon. What a shame that Marshallka feels so hurt by people who broadly supported her. I'm personally disappointed in that as it ultimately weakens what we're all here to do - help each other get their money back!

Now, BigDog, tell us all more about what you know!

Edit - Pinknico! Well done! You even scared them into submission!

And please let my comments fall down the list in case they make this appear a scarey place for newcomers to be!
Almost debt-free, but certainly even with the Banks!
