    I would do what Pinknico suggested, contact them in order for them to rectify this for you and ask if they can post you how this was actually calculated the way it was (an explanation).;) Then come back to let us know, cheers.;)

    Hi All,
    This is my first post!! But basically wanted some info. Not related exactly to PPI. So I am just sending a request to Black Horse about PPI and remembered they charged me for defaults I don't know exact figures but I remember them being excessive. Can I make a separate claim in the style of bank/credit card charges?

    Good luck with the PPI side of it and yes I am sure you can try for a separate claim on the charges, there is I think a separate thread for this.

    I wonder if they are stalling Boo :confused:

    Does it not give a tel number on the letter, ring that one and ask for the compliance department.;)

    Hello dearest Boo :A thank you for your above post. I too have had dealings with HFC who are playing dumb on two loans I had with them.
    I also had to send ID and fill out a form, still didnt get what I wanted. I have now copied the entries of the loans from my credit file and given them 7 days to comply, this has gone on since September 2008.:mad:

    Sneakily the paper work for SARS has no phone number on it, but I will have a look now and see what I do have.

  • This looks like a brilliant forum with a lot of helpful people, so I'd be grateful if someone who understands all this could take a look at my situation & see if a claim seems viable:-

    I've had an HSBC credit card (amongst others, but now the only one I own), for well over 6 years...I don't have the original sign up documents, or many of my paper statements (been shredding!) for the duration, but I just realised from this site (while looking for details on another issue) that I've been paying PPI on the card - which is normally 'maxed out' (currently at £8900) - for the duration of having it - hence over time, I must've paid a small fortune for the PPI = interest.

    Now, I think it's likely I signed up using a paper application form, sent in the post, so probably ticked a PPI opt-in box without properly understanding what it represented...and bear in mind, I have Type 1 diabetes (ie chronic illness), and also salary protection via my employment benefits, both of which would result in a decision NOT to take PPI (had I realised this!!) - in fact, Ive had several personal loans with HSBC in the meantime, where I've specifically NOT taken protection, as I knew my employer covered my, at least in terms of sickness.

    Since I don't think I had any discussion with a real person re. the PPI opt-in, I think it's reasonable to suggest I didn't make an informed choice - but it all feels a bit tenuous, especially since I've had the card, and been paying the PPI without question for so long...

    Could it be worth a claim, and on what grounds would give the best outcome (ie PPI not properly explained/discussed by the bank, the chronic illness issue, or the 'employer provides payment cover' route? Or indeed, a combination?)

    Any advice gratefully received....

    PS Also makes me wonder - I've had 2 x Barclaycards, 1 x Northern Rock, 1 x MBNA over the last 10 years - with a combined debt of £40K at one stage (all now paid off, no details kept), all of which had PPI on them (and all signed up on paper forms at home, not discussed with any of the banks concerned)....hmmmm?!?

    I have sent out 4 letters to different companies asking for details of PPI. However they have all written back to say I need to pay £10 for the information. Is this right? Please help!:confused:


    Hi Lizzie

    As KazC says, they should provide all the information they have on you on your account(s) and they have 40 days to do so as a deadline.

    So its an SAR request they seem to be stating here for ALL the information you require, here is the letter template for this purpose and there is also a reclaiming letter you can use, we will get to that one later if you want to and just deal with the SAR for now, here, remember to post by recorded delivery for these::::

    SAR - SUBJECT ACCESS REQUEST

    Dear

    Re: Account number:

    In the first part under the Data Protection Act 1998:

    Under the Data Protection Act 1984 and 1998, and including the right of subject access under these acts, please supply me with a complete list of transactions and charges relating to the above accounts held with you since they were opened.

    Additionally where there has been any event in my account history over this period which has required manual intervention by any member of your staff or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention or other evidence of that manual intervention in relation to my business with you.

    If you are unable to supply data relating to manual intervention because there has been no such manual intervention then please be kind as to confirm this in your response to this request.


    For the avoidance of any and all doubt, I reiterate:

    I hereby request that you supply me with any and all historical data in your possession which, in any way appertains to me, including (but not exhaustively) a copy of the original signed executed agreement; statements of account; duplicate statements and/or print outs of all account transactions; all internal and external correspondence sent or received by you including memo’s, logs, notes, screen prints and transcripts; notes of manual interventions such as telephone attendants' notes, copies of stored telephone conversations, internal and external emails; any other information held on any/all types of media in any relevant filing system (microfiche included).

    If you have disclosed any information to a third party (with or without my express permission), will you please include details of this in your reply, along with notes of any legal action passed or pending (to include a true copy of default notices, court orders and the like).

    Where any information that you provide includes any charges, for example returned payments, late payment fees, and so forth, would you please advise your breakdown of actual costs (liquidated damages) incurred for each charge, and the Term or Condition on which you rely upon to claim such a charge.

    I also require that you forward, within the above mentioned time scale, a true copy of the Terms and Conditions that were in force at the time my account was opened, and any subsequent amendments to those Terms and Conditions.

    I enclose the statutory maximum fee of £10.00 to access ALL data held by XXXXX about myself. You should be fully aware of your statutory obligations under the Data Protection Act and that any failure to comply with this request will involve a complaint to the ICO as well as potential legal action.

    You have 40 days in which to comply with this request.

    This communication has been sent Recorded Delivery so I can ensure compliance on these issues within the legislative timeframes.
