    Now, I think it's likely I signed up using a paper application form, sent in the post, so probably ticked a PPI opt-in box without properly understanding what it represented...and bear in mind, I have Type 1 diabetes (ie chronic illness), and also salary protection via my employment benefits, both of which would result in a decision NOT to take PPI (had I realised this!!) - in fact, Ive had several personal loans with HSBC in the meantime, where I've specifically NOT taken protection, as I knew my employer covered my, at least in terms of sickness.

    Since I don't think I had any discussion with a real person re. the PPI opt-in, I think it's reasonable to suggest I didn't make an informed choice - but it all feels a bit tenuous, especially since I've had the card, and been paying the PPI without question for so long...

    Could it be worth a claim, and on what grounds would give the best outcome (ie PPI not properly explained/discussed by the bank, the chronic illness issue, or the 'employer provides payment cover' route? Or indeed, a combination?)

    Any advice gratefully received....

    PS Also makes me wonder - I've had 2 x Barclaycards, 1 x Northern Rock, 1 x MBNA over the last 10 years - with a combined debt of £40K at one stage (all now paid off, no details kept), all of which had PPI on them (and all signed up on paper forms at home, not discussed with any of the banks concerned)....hmmmm?!?

    We suggest if you've no information, to begin with it maybe wise to request a SAR (Subject Access Request) where they should supply everything they have on you and must comply within 40 days, there is a charge of £10 cheque or postal order payment for this and always post by recorded delivery, as soon as you receive your documents, you may find some useful information within them to help you support your complaints.

    However, they may only supply going back as far as 6 years, but some are lucky to even receive documents from earlier years.
    We can then take this on to the next step.;)

    Although I posted the SAR template in an above post I will add here for your purpose.

    SAR - SUBJECT ACCESS REQUEST

    Dear

    Re: Account number:

    In the first part under the Data Protection Act 1998:

    Under the Data Protection Act 1984 and 1998, and including the right of subject access under these acts, please supply me with a complete list of transactions and charges relating to the above accounts held with you since they were opened.

    Additionally where there has been any event in my account history over this period which has required manual intervention by any member of your staff or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention or other evidence of that manual intervention in relation to my business with you.

    If you are unable to supply data relating to manual intervention because there has been no such manual intervention then please be kind as to confirm this in your response to this request.


    For the avoidance of any and all doubt, I reiterate:

    I hereby request that you supply me with any and all historical data in your possession which, in any way appertains to me, including (but not exhaustively) a copy of the original signed executed agreement; statements of account; duplicate statements and/or print outs of all account transactions; all internal and external correspondence sent or received by you including memo’s, logs, notes, screen prints and transcripts; notes of manual interventions such as telephone attendants' notes, copies of stored telephone conversations, internal and external emails; any other information held on any/all types of media in any relevant filing system (microfiche included).

    If you have disclosed any information to a third party (with or without my express permission), will you please include details of this in your reply, along with notes of any legal action passed or pending (to include a true copy of default notices, court orders and the like).

    Where any information that you provide includes any charges, for example returned payments, late payment fees, and so forth, would you please advise your breakdown of actual costs (liquidated damages) incurred for each charge, and the Term or Condition on which you rely upon to claim such a charge.

    I also require that you forward, within the above mentioned time scale, a true copy of the Terms and Conditions that were in force at the time my account was opened, and any subsequent amendments to those Terms and Conditions.

    I enclose the statutory maximum fee of £10.00 to access ALL data held by XXXXX about myself. You should be fully aware of your statutory obligations under the Data Protection Act and that any failure to comply with this request will involve a complaint to the ICO as well as potential legal action.

    You have 40 days in which to comply with this request.

    This communication has been sent Recorded Delivery so I can ensure compliance on these issues within the legislative timeframes.

    Hi, trying to work up the guts to make a claim on a £7000 loan which has now been paid off.
    Don't seem to hear much about Barclays, are there many success stories?
    Also, do you think I have a leg to stand on because I applied online, though the box for PPi was already ticked?

    What year did you take out this loan hun?

    Yes of course you have a chance with these and keep at them.

    How far have you gone on this one in regards of reclaiming? I take it you've not started this yet but want to know the results of others?

    Have you also checked this out on the success thread?
    There have been success with these as well, I'm sure you have a good chance with whatever reasons you may have.;)
