Glad to see I am good for something. :-) been talking to the FOS and managed to argue my case on the acceptance of complaints against the lender where a broker has been involved.0

That sounds good and hopeful then.

You have to prove beyond a reasonable doubt that you would have no way in knowing that a broker was responsible. Paying special attention to all the documentation and lack of any mention of the broker and its responsibility.
Further more, the broker is ACTING AS AN AGENT to the lender and therefore the lender does have liability to the agents actions.
I think the key thing to focus on is getting a rulling that the lender is liable by its own documentation. This can therefore not be disputed.
I guess its all about the evidence, the FOS chap told me that it is essential that the complaint focus on the evidence and argue why you believe the broker to be responsible.
It makes perfect sense..
On another note, just had a financial journalist from the BBC email me wanting to talk to me.. could be interesting. Hope I will have the opportunity to highlight the plight of fellow consumers.0 -

This is great Incipience.
I always assumed it would be the lender of whom you could complain to, after many letters sent to the lender they stated "you should complain to the broker" blah blah blah, I just thought I was being fobbed off.
