  • hi there everyone. i hope you are all well.

    Was wondering if anyone can help me.

    Have had a letter from FOS this morning telling me that they now have everything they need form me and my complaint (against Ocean Finance) is now waiting to be passed to an adjudicator.

    I have been waiting for months and months for it to get this far. So my question is, is it still possible to lose your case at this point or would they have already wrote and told me I don't have a viable claim?

    I am afraid it is still up to the adjudicator to make that decision.
    How were you mis sold?

    I was self employed when I took out loan. I'm a child minder so don't really know how long a contract is going to last for. Didn't know I had taken out ppi til I came on this site for claiming bank charges and saw the thread so checked my agreements. It was front loaded as well. I also paid loans up after 2 years as i re-mortgaged cos payments on loans were crippling me.

    Then if you didnt know you had it there is no better case of mis selling than that. Hopefully it will be passed to an adjudicator soon and hopefully he will think the same.

    Thanks for advice. Got my fingers crossed.

    Will keep you all posted. But with the length of time it appears to be taking will probably be after xmas. lol

    In March 2005 I Took Out A Three Year Loan With Barclays


    ................................Cash Loan Premium Loan
    Ammount Of Loan .........1900.00........... 336.73
    Tot Charge For Credit......557.36............. 98.51
    Tot Ammount Payable.....2457.36........... 435.24
    Monthly Repayment........... 68.26.. +....... 12.09 = 80.35
    Repayments = 36
    Apr 18.9%

    I Stuck To All The Repayments And The Loan Is Now Fully Paid Back.
    I Then Found Out About Mse And Investigated About Reclaiming Ppi
    I Believe I Was Missold Due To Health Reasons And Changes Of Employer At The Time.

    I Sent A Reclaim Ppi Letter To Barclays On November 24th 2008
    From Which They Sent Me A Questionaire And A Letter Saying It Would Be Resolved December 18th 2008..
    Then On December 17th 2008 I Got Another Letter Saying My Case Will Be Resolved By 18th Jan 2009..
    Then On The 21st Jan 2009 I Rang Them Because I Hadnt Heard Back.
    They Told Me They Are Running A Couple Of Weeks Behind, And That I Could Go To The Fos If I Want. ... She Then Said Its Probably Better To Wait A Couple Of Weeks Because The Fos Would Probably Say Wait For The Result Anyway Before They Can Proceed.

    Could Anyone On Mse Tell Me If This Is True Or Shall I Contact The Fos. Plus If Anyone Is Good At Maths What Ammount Could I Expect To Get If I Was Found To Have Been Missold Insurance..

    My issue regarding misseling of the ppi by BF has also been with the FOS for 12 months and is still no closer being passed on to an adjudicator....

    This is really annoying. especially when you read that people have had claims upheld within a couple of months. Don't get me wrong I don't bare grudges against any of them. good luck to everyone. What is annoying is when you contact FOS and they say they work on a as recieved rota basis which they clearly don't.

    I have three claims awaiting adjudicator and everytime I contact them I get the same reply. I know they very busy cos they must have hundreds of thousands of claims right now, I just wish they would follow the system they say they have in place. And you don't want to get stroppy in case they put your claim to bottom of the pile.

    Markz--re the Maths side of the question

    You would expect to get back:
    1)-All the SPI premiums paid (36 x 12.09) = 435.24
    2)-8% interest on each of those premiums from the date you paid it (starting back in March 2005) to todays date (i will assume 31/1/2009) which would be 83.13
    So,in total £518.37
