  • Seems odd, but not suprising.. However if this is an issue of mis-selling then you can take action against the insurer Scottish Provident as they would of paid a commission to the broker and therefore legally are liable.

    Just to let you know I received the details for why Creation want to set aside.

    They have basically said they believe they have a proper and viable defence.

    Surely they should have submitted this defence within the 28 days after the claim was issued not 4 months later!

    The hearing has been set for next Friday. They have given me 1 week notice for a 10 minute hearing which takes place 100 miles from where I live.

    Does anyone know whether I have to attend or not?

    Can you ask for it to be moved closer to you? I think that if you dont attend they win by default. But dont take my word for it the court should tell you what options you have. I will try and find out more.
    According to MCOL if the defendant is a business it should go to your home court.


    "If the defendant files a defence and the defendant is an individual, the case will be transferred to the defendant´s home court. Where the defendant is not an individual (ie: the defendant is a business), the case will be transferred to your or your representative´s home court. This means that your claim will no longer be handled by the MCOL system. "

    HSBC PPI states you need to be unemployed for 60 days after signing on the dole, in order for any PPI insurance to be paid.

    Thats just wrong
  • After going straight to HFC bank to reclaim my ppi costs (I never knew i had) and being fobbed off i went straight to the ombudsman which has now been 12 months ago and they still havent got it sorted out or even passed it to a judicater yet, what can i do ?

    They will not look at it until you have exhausted HFC's complaints procedure and received your final conclusion letter, only then can you go to ombudsman.

    Have you rung the FOS and have they been keeping in touch with you about your complaint?

    Im back again

    So to update you - I was going to re-claim my PPI as I was paying £90 a month to be covered for accident sickness and unemployment for £1500 a month enough to cover my mortgage and to live off
    When I started lookin into this I only realised then that they would pay out for 12 months - when I contacted them both Pinnacle Insurance and Northern Rock denied any knowledge of selling me PPI - so I said right if I cancel the direct debit you will soon be admitting to it then...which they did I ancelled it at xmas and I got a letter through 4 days later! Unfortunately during that time I lost my job...so I rang them and said I had spen too much money at xmas so it must have bounced and I woudl re-instate it
    Now its nearly February and I am wondering when I should ring them to say I lost my job I am claiming JSA....or should I wait a bit longer???:confused:
