SAR - SUBJECT ACCESS REQUEST
Dear
Re: Account number:
In the first part under the Data Protection Act 1998:
Under the Data Protection Act 1984 and 1998, and including the right of subject access under these acts, please supply me with a complete list of transactions and charges relating to the above accounts held with you since they were opened.
Additionally where there has been any event in my account history over this period which has required manual intervention by any member of your staff or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention or other evidence of that manual intervention in relation to my business with you.
If you are unable to supply data relating to manual intervention because there has been no such manual intervention then please be kind as to confirm this in your response to this request.
For the avoidance of any and all doubt, I reiterate:
I hereby request that you supply me with any and all historical data in your possession which, in any way appertains to me, including (but not exhaustively) a copy of the original signed executed agreement; statements of account; duplicate statements and/or print outs of all account transactions; all internal and external correspondence sent or received by you including memo’s, logs, notes, screen prints and transcripts; notes of manual interventions such as telephone attendants' notes, copies of stored telephone conversations, internal and external emails; any other information held on any/all types of media in any relevant filing system (microfiche included).
If you have disclosed any information to a third party (with or without my express permission), will you please include details of this in your reply, along with notes of any legal action passed or pending (to include a true copy of default notices, court orders and the like).
Where any information that you provide includes any charges, for example returned payments, late payment fees, and so forth, would you please advise your breakdown of actual costs (liquidated damages) incurred for each charge, and the Term or Condition on which you rely upon to claim such a charge.
I also require that you forward, within the above mentioned time scale, a true copy of the Terms and Conditions that were in force at the time my account was opened, and any subsequent amendments to those Terms and Conditions.
I enclose the statutory maximum fee of £10.00 to access ALL data held by XXXXX about myself. You should be fully aware of your statutory obligations under the Data Protection Act and that any failure to comply with this request will involve a complaint to the ICO as well as potential legal action.
You have 40 days in which to comply with this request.
This communication has been sent Recorded Delivery so I can ensure compliance on these issues within the legislative timeframes.
Yours Sincerely

Good Luck to you.:mad:0 -
PPI or payment protection insurance does jsut what it says on the tin, it will only protect the payments on a loan, generally payments are made direct to the lender.
There are many exclusions on these types of policies and are quite tough to obtain a payout.
Income protection works slighly differently, the assured requests an amount of money to be paid to them DIRECTLY in the event of their incapcity. This is usually a % of the previous years salary say 65%..
These work well as the deffered period (time until the policy will start to pay) can be arranged to co-incide with your employers sick pay ending.
These policies do get more expensive with age and women are generally more to insure.
They do however provide an income when they are most needed.
Alternatively a Critical illness policy would do the same, however would provide a lump sum. Generally the diagnosis of a critical illness (cancer, stroker etc) will start the claim, if the claimants survives say 14-30 days then the policy pays.
I would recommend speaking to an IFA or doing a web search. It is very tricky to get the right policy, ask friends or family to recommend and IFA, the best way to find one. There are still lots of genuine IFA's who will be able to help, however there are still some cowboys out there.
THis is a very brief over view, feel free to ask any questions if something has not been explained clearly.

We've decided were not going to complete the PPI questionnaire, we're just going to send it back uncompleted, but does anyone have a covering letter I can attach to explain why the questionnaire is not completed.
Hi 10past6
Sorry I have not posted earlier.
You can just write you have already explained your situation in your letter, I think loads have done that, and they still have to get back to you within that timescale of 8 weeks they have.
They tend to use this as stalling tactics.
The covering letter states if we do not complete and return the questionnaire within 14 days they will assume we no longer wish to proceed with our complaint / claim.
I would tell them you wish them to proceed with your complaint and feel you have given them enough information to also investigate your complaint.
It seems like they are using this as an excuse.
And don't forget you still have the FOS if they do not do so.
I see that Maxdp has also helped here here as well, good luck hun.;)The one and only "Dizzy Di"0 -
Hi di
Pleased to see you back on again, I trust all is going OK for you
What about this letter, should I amend the way it's worded?OK, how does this sound, short & sweet:
"Reference your recent questionnaire regarding PPI attached to my loan.
Please find enclosed the requested questionnaire uncompleted as I believe the details you're requesting are held on your own databases taking into account NO claim has ever been made against the policy"Click here for Martins (MSE) advice on who to contact with Debt Issues - YOU HAVE NO REASON TO USE A FEE PAYING DEBT MANAGEMENT COMPANY- THEY CANNOT DO ANYMORE FOR YOU THAN THOSE LISTED IN MY LINK ABOVE.
All information given by myself is offered informally and without prejudice - if in doubt seek help from a qualified and insured professional0
