Hi,
I was wondering if anyone out there could give me a bit of advice.
I took Creation Financial Services to court for PPI payments and the claim was made 14/8/2008 and was acknowledged by them on 1/9/08.
They did not provide a defence and therefore a default judgment was made 17/9/2008.
They did not pay up so a warrant was issued on 15/10/2008. The bailiffs have been unable to recover the monies.
Yesterday, over 3 months after the warramt was issued, I received notification that the defendant wanted to set aside the judgement.
Are they able to do this. I thought that once a judgement had been made it was final as a defence had not been made.
It seems pretty bad to me that I go through the whole small claims system and do everything by the book and then the defendant decides 4 months after the judgement that they wnt to set it aside.
The only advice I can give is ring the court who will tell you where you stand. I have heard of companys doing this but not as far a long in the process.DS1 12/10/04

HI we took out a loan with ge money in november 2006. we took out ppi with this loan because the sales person said with a loan of this size secured on our home it was the wisest thing to do. the ppi added an extra £2750 to the loan amount. In April 07 my husband took ill and we submitted a successful claim to ge money , we received help with our loan for approx 6months.
since reading the boards on here i have started thinking about the policy we took out , we were never advised that we would be paying interest on the ppi for the full term of the loan (10 years ) although the policy only covers us for 5 years . We were never advised that the protection could be purchased independently from another company. We were never advised that pre-existing illnesses would not be covered by the poilcy and we were never asked about our medical history even though my husband has a life-long medical condition which would render the policy useless should he ever need to make a claim for this condition.
I contacted ge money and asked if the poilicy could be cancelled from here on in and we were abruptly advised that we have made a claim on the policy so NO it cant be cancelled and NO we were not entitled to any form of rebate. Are they right in what they tell us ? We may have made a claim but it WAS NOT for his pre-existing illness , it was for something tottally different.
