    Hi all
    Just joined today but have been reading this thread with interest for a couple of months!! Sent letter #1 to Northern crock a couple of weeks ago and requested copies of my agreement etc. all I got was the form they send out. I phoned them up and got some details for the form and have posted it back, so I await their response:rolleyes:

    i was just wondering if it's worth contacting Egg as well?? I cancelled the payment protection thing (or whatever they call it) before Christmas, got £8k on the card and it was an extra £70+ per month going on to the balance!!!! Is it worth sending the letter in to them to try and reclaim as I've had a similar balance on that card on and off for 6 ish years? I can't remember what process of application I went thru tho?? Will that go against me??

    Yes go for it with EGG if you believe you have a case here.

    They may try to use things against you but fight your ground and keep at them. Good luck.;)

    So your still having problems with HFC then ?

    Now that is up to you Boo if you want to cancel, but you may not receive much of a rebate if any......depending on what it says on the terms and conds of this. And it means a new loan as well.....

    So you've not sent the complaint/reclaim letter to HFC yet then ?
    You can still do this whilst waiting for your SAR Boo if you want to that is entirely up to you, unless you want to see what does come back within the SAR that maybe useful for your complaint.;)

    Regarding First Plus there are many complaints of PPI against these currently, in-fact more so than any other company.
    To what I know of they are not the easiest to deal with, but I would try to reclaim on this anyway.
    The FOS (Financial ombudsman service) have a HUGE amount of these actual complaints (FP) and I'm sure you will come out a winner either way by the company or the FOS.

    May I just ask who arranged the loan for you, if this was not arranged by FP you may have had a broker. Write to the ones who arranged this for you.

    There is some useful PPI info and a template letter.
    See if there is anything to add to your other reasons so you can add all this in your letter, try to keep the letter in your own words if you can and they have 8 weeks to respond in full.
    Another letter maybe required if not successful first time, until you receive a final response from them, also the final response should also enclose the leaflet to the FOS to give you a chance to take your complaint to them.

    Let us know and we can take this from there if required, good luck and post by recorded delivery.;)

    Sorry to hear of your friend's issues here.

    Do you mind if I ask if your mate had this condition when taking this out?
    If this is the case then this may help you with the questions they are more or less asking, or cover them anyway due to memory loss.
    You could also ask the CAB to help in this case as well, maybe they could dig further on this for your mate.

    Also this seems to be a common clause in these conditions of making a claim, unfortunately.

    Who was this loan arranged by and who with and date?
    You actually write to the ones who arranged the loan.

    If you believe any of this occurs to your mate, like a lump sum added etc as there are many other reasons as well for this mis selling.

    Check out the template and try to write in your own words, "tell them you are writing on your friend's behalf due to the health condition and any other reasons you feel this may have been mis sold".

    They have 8 weeks to respond in full.

    Let us know the outcome, as another letter with further information maybe required.

    I have already sent out the 1st suggested letter to Firstplus and had my 1st reply back today, saying that the loan was sold to us by Freedom Finance, and they would be unable to investigate and that they will forward the complaint on to Freedom Finance.

    What should I do now???? any ideas!!!

    Right then if they have already done this, ask them when they sent this so you can keep an eye on the 8 weeks they have, because if they do not get back to you within that time you are entitled to continue to move on to the financial ombudsman service.
    You could always contact Freedom Finance to ask when they received this and keep a check on the dates from there.;)

    When the loan and PPI is sold through a Broker, is it still possible to make a claim? who is liable to refund if a success?? and will the Broker try to fob me of too???

    Sorry about all the questions, but i'm soooooo unsure of this whole process, but determined to fight for my money.

  • With mine the broker was responsible cause they sold it to me. They allfob you off but you have to keep on at em.

    Not a problem I understand.;)

    We have always been told its the ones who actually sold this to you a broker then.;)

    However, some will say lender..if they arranged this as well.

    For instance I had a loan arranged by a broker and I am now dealing with that, the broker arranged the loan with lender called Nemo, although I did have a loan advance with Nemo and again mis sold the PPI by these, and this was won dealt with by the FOS on the loan advance......hope this gives you an idea, as its only been over a year since I have learnt about how PPI works etc I dealt with the 2nd loan complaint of the loan advance first before the broker for the first loan they arranged.

    On my paperwork from the FOS, as they resolved the 2nd complaint then through Nemo, they said if I had a reason to complain on the first loan, then I would have to pursue through the broker.

    Hope I have not confused you......:o , let me know if you want this explained again hun just in case if you want me to lol.
