Tesco misprice policy discussion area II

Odd_Fellow wrote:The fact is, it is absolutely irrelevant if they are intended to be Internet prices or prices you can get elsewhere. If they are using such marketing collateral to draw your attention to an item they have for sale at £X price and the collateral does not make it abundantly clear that the offer only applies in XX circumstances (small print is not sufficient in these cases) then the lower price must be charged. Consumers are not expected to have to read the small print of offers such as Shelf Edge Labels and marketing posters in store.0

Went into Tesco Congleton today and bought disney 3 disc scanned £12.97 poster £8.97 went to CS who said poster should never have been put up..... it was not by one of their staff it is an outside company that comes in and they do not do that price in store... Asked for money back as not happy to pay that price and they said they only have to honor SEL I explained that I presumed that was the full price but this week was offer like it says on poster but CS said no the price is on the SEL!!!!!
Really miffed as this was my first misprice and seen on thread other people manage to get away with it!
Any hints?
Thanks
Yes CS tend to resist with poster mis-prices - but not always.
If you get resistance, remain cool, calm and polite - this helps a great deal.
I use the "Consumer Protection Act (CPA) and retailers showing misleading prices is an offence" as an opener.
Then the "Office of Fair Trading (OFT) interpret the CPA in context with more than one price shown as the lower price being applicable" (I've no idea if this is accurate......)
Closely followed by "The OFT will investigate and fine Tesco if the R&R policy is not implemented" (again I've no idea what I'm talking about.....).
I usually throw in a couple of "it's not personal" comments - but it seems to sow the seed of doubt in the CS mind over the possiblity of getting their employer into trouble.
I also throw in a suggestion that CS ring Head Office on 0800 55 50 50 (??) who will tell them to refund (again, blowing smoke up their backsides probably....).
Using the above, CS usually cave-in fairly rapidly - I've never had an R&R refused - I've had many of the BS excuses - and I've only once had to use all of the above with a very resistant manager in Gloucester - she caved-in too.
HTH - Good Luck!!

You say Tescos rules are only 2 of the same mispriced items and no more. Can I take my 3 children in with me and take 8 mispriced packs of mackerel? Then that would make it really worthwhile. Is there any age restriction in their terms and conditions to stop childrens purchases other than for alcohol and cigarrettes?0

8 mackerel for 3 kids, seems a fair exchange to me0

Went to my local Tescos on Saturday hoping to find misprices on CDs as there seemed to be a lot around this week. Most upset to find all the prices on the CD poster had been covered by white sticky labels. Someone had either beaten me to it, or Tesco staff covered them up from the beginning. Bit of a cheek if they are supposed to be special offer prices.
On another note, on Christmas Day my Dad was telling me about how Tesco had overcharged him on a Lexmark Printer Cartridge by 10 pounds, but he said everything was OK, because he had gone to CS, and they had eventually agreed he had been overcharged, and he had got his 10 pounds back. You can imagine my reaction!! I explained to my Dad what Tescos policy is, and that he should have been refunded the whole amount. He took some persuading, but when I told him the things I had had refunds on he began to get the picture. Now, my Dad is 74, and I hate to think Tesco had taken advantage of him. I offered to go back and sort it for him, but he said he would go back to them. So after Christmas the phoned the store, and they confirmed the policy to him, so he went back to the store and got the rest of the money he was entitled to. (He nearly got the cost of two cartridges refunded, but he was honest enough to say he had only been overcharged on one). Result.............one happy Dad who will always check his receipt from now on.
Happy New Year to you all0 -
Oakey22 wrote:got one of those starter pc's earlier wiht a 17" samsung monitor. Had a label that ran out on the 24th. got r+r
£359.99 r+r and no arguing.
1 little thing though, he came back aske dofr my card and said ok ill refund it, i said how much. he saidd the £50. then i stated the promise behind him and he went to see his manager again. came back and said, ok. you can have it all back
I picked up the same deal on Saturday 31st. The SEL was 199 on the pc and monitor with a yellow card stating £50 off however when it went through the till it came up as 199 for pc 159 for monitor so i thought (not doing my maths properly) that the 50 had come off. On the way home I mulled it over and realised I was only saving £40. So next morning turned up bright and early as they opened to query. After checking that I had the right monitor was told that the offer had now finished but as they hadnt taking the price down they would honour the offer and give me £50 refund (although they could not work out how to do it). I mentioned their r+r policy and was told that this situation was different and it was the same with the mobiles? and then she (CS) had confirmed with HO that the full r+r was not applicable.
I did not want to argue at this point but asked her to write on my receipt that the £50 had not come off and I would ring HO on Tuesday to check.
What are my chances of getting full r+r? would there be any point in going to another store as my receipt now shows that I have been in touch with the original store? or should I just take my £50 refund and try to get refund on PC (£109 for 17" TFT monitor must be good?)
any help out there. sorry for long post! - whoops just made it longer by apologising! - Doh!!0 -
Just got back from Tescos. The x box and Acer lap top all seem to be scanning in on correct price.
Pity they still don't seem to have corrected the cds, although they have course taken down the poster.
Divorce all finished- now to start saving for a better future!0 -
I bought a carton of fresh double cream reduced on new year's eve and now I find that the 'till monkey' as someone else put it earlier has messed up and charged me once at full price and again at the reduced price for the same item - so the reduced item has just cost me more than a full priced one would have! I'm gonna take the receipt in today and see what they make of it.0
