Unfortunately not.
A. The FSCS doesn't have a duty to pay compensation until they declare a firm to be in default. This happens after (1) they receive a complaint from at least one person and (2) they investigate and after investigation, make a declaration of default. The mere fact that a payment hasn't been made within a reasonable time doesn't put a bank in default for the purpose of FSCS.
B. When the Government transferred our KE accounts to FSCS, the order they promulgated expressly provided that FSCS no longer had any obligations whatsoever to us. In law, therefore, FSCS have no duty to pay us even if KE / ING Direct is in default.
KE was declared to be under default. That is my understanding (right or wrong). End of story.....Illegitimi non carborundum

KE have just told me that all CHAPS will be sent - not sure that's 100% true - however the following is useful:
Ring your customer service dept and ask if your bank works in real time or traditionally. If it works in real time and the money does not appear in your account by the morning then the payment has not been received and we need to contact ING/KE. If your bank works 'traditionally' then you will not know one way or the other until Monday.
I think it's worth keeping each other up-to-date with this in the morning. Helpful?CHAPS 8th Oct Rec'd 20th Lloyds TSB0 -
Thought it was a bit harsh too
Yeh, just checked my calendar and it is my harsh day of the month. Apologies to anyone who got in my way, on this of all days.

I have just spoken to Alliance and Leicester customer services and was assured that there was no transaction pending on my account and that it would definately be Monday morning before anything would show uo now.
Well done ING, thanks for another worrying weekend :T :T

I'm never going to just close an account in future. I've learned from this that to withdraw all and then close later would have been the best option. God knows when I'm going to get my money!
Sorry I don't follow this. What difference has this made?
I cleared my account to 0 and haven't seen my money yet.0 -
Well, the witching hour has come and gone, and still nada!
I haven't shouted, or tried to blame anyone, or spent hours phoning so far. I kept faith and really thought it would have been sorted by now. I am so disappointed!
I think the term deposit that I had intended to leave with ING will now also have to be withdrawn. If they go under and the FSCS have no intention of doing anything further for us, then I will be really, really angry.
I've got the red wine open now and intend to drink the lot! I used to be happy before I had any money! Now I'm miserable and worried all the f****** time!
I know I should be grateful that I'm not having my house repossesed like some are, but this money was my one chance to avoid a miserable poverty-stricken old age, and would have allowed my kids to have the massive 25% deposit they'll need for a house.
Mine was CHAPS about 8am on the 8th to the Halifax, by the way.CHAPS 8/10 received Halifax 20/10
BACS 18/11 (£30) (actioned 19/11) received CHAPS Halifax 21/11
BACS 24/11 (£50) (actioned 25/11) received Halifax 28/11
