No you don't have a claim against the FSA.
If you have any claim at all, and I don't think any of us do, yet, it's with the FSCS who provided the protection to 50K for the KE accounts, not the FSA.
I would have thought, that we have had a claim against the (FSA or FSCS), ever since KE failed to act upon our CHAPS transfer request within a reasonable time (9 Oct in my case). Having failed to carry out the request, theyre in default, hence the claim. Hence the first port of call is whoever (FSA or FSCS).....Illegitimi non carborundum

First Direct too! It definitely won't be credited now until Monday, according to their foreign department, who deals with these things...

I don't think ING is as safe as anywhere else.
Firstly it's protection is based on the passport scheme, which will never look after foreign savers first (look at Iceland). UK savers will always be favoured by UK schemes.
And although a good brand and large safeish company, it's not as safe as companies like Lloyds or HSBC.
ING also have a history of offering good accounts to lure savers, then dropping rates fast, which is why they are rarely listed on the best buy tables.
For me foreign saving is over, I've no interest in ING whatsoever.
Interesting point you make. Must admit, I don't really have an issue with ING, other than the fact that I DO AGREE with what you say about the fact that they offer new customers better rates than their exisitng ones, and indeed I am not only an ING saver, but also (yes, I know, sadly) a Formula One fan, and ING advertising is plastered EVEYWHERE there - on cars, posters, drivers tunics and caps, etc etc etc... better they should redirect their (unknown amount) of Guilders / Euros / GBP equivalent / towards giving customers (savers) a better interst rate rather than wasting their profits on F1 sponsorship. (and I've said the same in an e-mail to a senior ING manager (to which I got a kindly but non-commital response!) ))
Also take your point about the foreign nature of the bank - but - unlike Iceland, it is indeed fully within the Euro-zone - and don't mistake the difference between what happened to IceSave with what was "forced upon" KE - caused by quite different things.
Heyyy - ANYONE that can afford to pay for headline F1 sponsorship MUST have plenty money !

A. The FSCS doesn't have a duty to pay compensation until they declare a firm to be in default. This happens after (1) they receive a complaint from at least one person and (2) they investigate and after investigation, make a declaration of default. The mere fact that a payment hasn't been made within a reasonable time doesn't put a bank in default for the purpose of FSCS.
B. When the Government transferred our KE accounts to FSCS, the order they promulgated expressly provided that FSCS no longer had any obligations whatsoever to us. In law, therefore, FSCS have no duty to pay us even if KE / ING Direct is in default.CHAPS to Natwest: sent 9/10, RECEIVED 22/10 at 16.350 -
I can't recommend First Direct highly enough, actually. They're always there, no waiting, and have been very good to me for the past 15 years...0
