    I made a payment earlier and it seemed to be working. I'll find out by Weds/Thurs if it's gone through ok.

    I would certainly suggest that anyone who has been affected worse than me, i.e., bank charges/missing payment due date etc., to go for it big time...

    Those customers affected badly should at the very least demand that they pay for any bank charges incurred for being overdrawn as a result. They should also expect to be compensated for inconvenience caused....The words "legal advice" to a senior manager might work wonders.....!!;)

    i have sent a final secure message to them, i have stated that i expect the payments to show as a credit to my account by 5pm on monday which will make it 7 working days since payment was made. if they dont i have told them i will complain to FSA. we will see what happens now!!!

    I would suggest that people who have suffered from multiple payments to Capital One when they were only supposed to take one would be entitled to charge Capital One interest on the funds that they have illegally removed from their bank accounts. Perhaps interest charged at the same standard variable rate that they are currently paying to Capital One would be appropriate.

    In making a horrendous mistake such as this (I am sure that it is programming error somewhere down the line) Capital One are opening themselves up to some serious legal challenges - they have effectively taken funds that they had no permission to do so and this could be classed as theft.

    hi all,
    just an update on this and my duplicated payments.
    i just recieved answer to third secure message, just another bog standard answer with fax with statement ect. i got email notification of it at 5.30 am this morning so its obvious these are coming through from india too.
    in my last message i stated that i expected the payments to reflect on my account by 5pm today or i was going to complain to the fsa,
    they have been accruing interest over the last 7 days on this and i have been accruing interest on my balance which if the payments had credited when they should would have reduced this interest.
    i am today going to send by recorded del a copy of my statement and a complaint letter to cap 1, i am also going to send a complaint letter to the FSA and include in it copys of my letter to cap 1 and a copy of the secure messages which the second one confirms they have my payments!!

    so angry about this now, its not going to drop until i get answers!!

    I've got one payment back today, despite saying a CHAPS transfer went through on Friday. Rang up to complain again and the call centre wouldn't put me through to the exec office.. I spoke with a complaints manager and he guaranteed it will be sorted by Friday 10th.

    I do wonder if that guarantee is any more accurate to the one the week before?!?

    not one nicky hutch!! but letter of complaint, copy of secure message stating both payments were sucessful and copy bank statement sent recorded today and a stiff complaint letter too!!!
    we will see what happens next!!

    what a bl**** joke!

    Just tried to pay by debit card this afternoon, - computer said no, so left it a while and tried again - computer said no
    So I called Capital One - asked "can I make a debit card payment over the phone please to pay my balance as it's not working online - Indian lady says no!

    I ask why - because we are updating our system, please try again in one - oh no wait maybe two hours!

    I will try to pay it online again in the next few hours, but what a fiasco!

    I'm just cross that they can't even get their act together enough to reply to the secure messages I'm sending, just to say "thankyou, yes we've got your fax and letter" and "so sorry for all the inconvenience". They're just bloody rude.
