Orange - Can I Get Out Of My Contract

    Anyone had any response?

    Had two people from Orange call - the first claimed that the charges had increased due to new government legislation. I told him to come back to me with evidence.

    On chasing again, another lady came up with the additional services line. I asked her to put this in writing to me. This was almost 2 weeks ago and no letter received. I've called again once to chase up.

    It appears that Oranges answer to this problem is to just ignore it!
  • 15.1 We do, however, reserve the right to vary the terms of this Contract from time to time and to make changes to your Service Plan. We acknowledge that if we do increase the Charges, withdraw Orange Additional Services or introduce new mandatory Charges - or if your contractual rights are affected to your detriment - you may terminate your Contract in accordance with Condition 4.3. If you do not give notice within one month of our notifying you of any change(s), you will be taken to have accepted the change(s).

    Looking at this extract from the Orange contract it seems that you are still entitled to cancel your contract even if the additional services terms are altered.

    The additional Services line that they are giving people is dodgy also. I am still not convinced that MMS is an additional service in anycase.

    Could end up being a matter of definitions.
    Most handsets have MMS inbuilt, BUT the MMS element on the customer account screens on the Orange system are classed as additional services, they have to be added to acc's to let the MMS service work with the handset. If the MMS element is removed, MMS stops working.
    An acc is built from a number of these elements...

    I have faxed them this evening and are awaiting response. I think if you keep hassling them about it and ultimately mention Ofcom and the other governing bodies like http://www.cisas.org.uk/Members.asp they will have to give in.

    Indeed, but they may ague that MMS isn't part of your Service Plan (as noted in 15.1 of the T&C's quoted above). MMS is an addon and isn't part of the service plan. I think Orange define service plan as just the talk time element (at least, they used to).
  • I know, but the terms say that even if they withdraw, increase charges of additional services then customers are able to cancel as stated in 4.3.

    It kind of goes back on itself.

    I get the feeling that they'll ague each case on its merits (ie, if you kick up enough fuss, you just might get somewhere...).

    Bit of a thread resurrection!

    I have had a response saying that I am able to cancel the contract- however they want me to buy out of the contract. They are saying that because I don't use picture messaging that much I am not able to cancel.

    I don't know if this is ok or not or if I have any grounds to say otherwise. The contract says I can cancel if charges are increased to my detriment, but how can I prove that they are to my detriment?

    Think I maybe losing this battle :(
