What is th elatest status, has everyone who submitted their claim on or before the 8th october now been paid out, and how many of those claims were NOT paid in full?
I believe there are still people waiting for refunds who started their claims after the 8th so please post when you get your email from paypal so everyone knows where they are up to and anyone who doesn't get an email from paypal will know they need to contact paypal ASAP.
if anyone doesn't get paid out in full I'll see if I can grab some links to the complaints procedure on paypal so you can try that. Also of course, as others have mentioned if you paid by credit card then a chargeback via the card is possible and there is also a (different) sort of chargeback available for those who used a Visa debit card.
Th eone advantage of going in to paypal via the complaints procedure is that they respond to emails very quickly and if you cna get them to say, in writing, that you are due more of a refund that is something you can use against them if they fail to pay up.I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards. This is the link to make a complaint about paypal themselves and to be referred to a more senior operative:

If anyone was promised a full refund and did not get it then use this route to try and get someone to confirm in writing that more is due.
This is the actual form you get:

The scum bag had no money in the paypal account hence we haven't recieved any money.Feelin bit depressed as, eventhough i didn't think I would get back the money, it hit home yesterday. Not very well and not upto a fight with the bank!!:embarasse The only glimmer of hope, if anyone else is int the same boat as us is we found this article:
http://www.telegraph.co.uk/global/main.jhtml?xml=/global/2006/09/16/cmdeal16.xml
Which said:
Paypal offers more protection than other online payment systems because the company has both an internal disputes system for purchases worth up to £500 and a charge-back "safety net" arrangement where valid claims are made by credit and debit card issuers
The following credit cards told the Telegraph they will support a valid claim by using the charge-back system offered by Paypal: American Express, Barclaycard, Bank of Scotland, Britannia, Capital One, Co-op, First Direct, Halifax, HSBC, Intelligent Finance, Liverpool Victoria, Lloyds TSB, Marks and Spencer, MBNA (including various charity and other affiliated cards), Mint, NatWest, Northern Rock, Norwich & Peterborough, RBS, Saga, Sainsbury's, Smile, Tesco, Virgin and Yorkshire Building Society
The following debit cards will support a valid claim by using charge-back systems for all purchases: Abbey, Alliance & Leicester, Bank of Scotland, Barclays, Citibank, Co-op, Coventry Building Society, Halifax, Intelligent Finance, Lloyds TSB, Nationwide, NatWest, RBS and Smile.
It seems to suggest that the bank get the money off paypal. We rang paypal and they said this is true. We have to go to the bank and put in a claim, 30 days after purchase, then they pursue the money through paypal. Paypal then have to pursue the money from the seller, through debt collectors if neccessary. From what I understood this is after we have been given the money. The other half rang the bank this morning and he said it sounded hopeful. So there is a glimmer of hope but we have to wait til next Monady to activate this!!
Going to curl up on the settee now and resume the scumbag fight tommorrow!!No Unapproved or Personal links in signatures please - FT30 -
You don't need to wait to go to your card provider for a chargeback, as soon as paypal fail to repay you you can start the claim with your card company.
However be aware of a couple of points, firstly the card issuer will put up a fight and possibly even deny it is possible so be persistent. Secondly, and possibly only a minor issue is that paypal may well close your account with them as it is against their rules to go to a chargeback via a third party..personally though if a lot of money is involved I would take that risk!
The reason that paypal don't like these third party chargebacks is that it is paypal themselves that the card company charge if the seller has done a runner, but don't let that worry you!
I did fear this as an outcome with paypal and I am just so gutted that my worries have proved to be right for some people.I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards. Hi, I'm trying to claim back £170 from discount-buggies via paypal , can anyone tell me if I have to wait for the initial 10 day paypal request to discount-buggies or can I push paypal for a refund ?

Pilch,i hope you are feeling better today.......and have got your fighting spirit back,c'mon girl lets gets the old adrenalin pumping!!!
Great to hear of some refunds,we knew it would be a fight though so now is the hardest bit!
I really think watchdog should have taken this on......i mean its a news worthy story, even if watchers havnt been scammed themselves it would give them a wake up call to an up to date scam.
well done anyway again everyone :money:
xxxit takes more energy

I bet you are all glued to the TV tomorrow evening to see if it gets a mention on WATCHDOG. I can only presume that the seller has agreed to refund you all, whether this has been done by enforement by the police or not it will be interesting to see. I think you will find he has been captured and has been forced to refund. I think by quick actions by the people on here we have ensured this scammer did not disappear into the sunset. Have any of you had feedback from the police ?
I have still not had any response from the police regarding the email I sent last week. I think someone mentioned that the lady dealing with the case had been away til Saturday, so I thought i'd give her a few days to respond (she may have hundreds of emails regarding this case!).0 -
Hi guys, I have just received an email from Paypal saying that the whole amount (£350) has been refunded!!! I am so happy! Thank you for your help!
I hope all of us will get their money back! I will keep my fingers crossed!
Now we need to focus on getting this guy! Maybe we should call the police lady and ask her for the update? Did they check the address, tel no? Has something been done?0 -
Does this mean that people who bought items before the new Paypal buyer protection rules came in, but claimed after, aren't getting their money back? I'm a little confused - I paid for the buggy on 23rd September, but didn't issue a chargeback with Paypal until 15th Oct. Does this mean that I'll have to wait to see if Paypal can get the money back from the seller, or will they pay out anyway after my ten days?0

Agree the refund situation is confusing especialy as the new paypal policy came into being after many of you purchased your items
Reading the posts in the thread paypal CS advisors had told some that had purchased through ebay listings, that they would get their money back in full (this was even if the listing had only shown the £150 buyer protection)
Yesterday MonikaD in #569 stated
well I am not so lucky - got only £150 back - even tho has been told on 4 ocasions that I will get the whole amount back. Just off the phone and the guy told me that I won't get a peny more back. ^&*^*^*
and in #577
Just been told that I will get the extra £200 back - we will see... I will believe it when I see it.....
and today good news for MonikaD as #601 above

So it seems as long as your paypal transaction was carried out following bidding on an ebay listing, you will, if the dispute has been escalated to a claim which is found in your favour, get a refund it doesnt depend on paypal being able to get the money back from the seller0
