Sorry I haven't read this thread as its huge. Can you claim back charges on accounts which are now closed? My Dad paid a fortune in babk charges with a failing small business. I joined the Consumer Action Group Site yesterday but its alot to take in at first. Many thanks,Nevermind the dog, beware of the kids!0

Well done on getting the Tomlin Order.
As for Chelltune,
Yes, the bank keeps records for 6 year's.
Ask them for a DPAr (Data Protection Act request, may cost £10) and go from there, work out the charges and send them a letter.
Hopw that helps.0 -
Just a few questions. I sent the bank action website recommended letter asking for repayment of fees.
Some banks have said no, a cuple of credit cards have refunded charges and a couple have made an offer.
My question is how should I now deal with this. The first fourteen days have elapsed and I'm now going to be sending the letter before action.
For the banks who have made a partial offer should I amend the letter saying I accept the offer however require the remaining x amount?
Many thanks0 -
Just bumped this as really need some advice!0

we got a letter saying that Natwest had acknowledged our claim so from info I've been given on the bankactiongroup web site, it seems that they have 28 days from the date the claim was deemed to be served (15/04/06) to come up with a) a defence or b) the money!
Now whilst I hope the answer is b) (!!!) is there anything I should be doing in the meantime, just in case the answer is a) ?
At the moment it seems that the cases involving the smaller amounts are getting settled without the case going to court but as ours involves £2K+ I am preparing for the worse case situation especially as Natwest seems to be the only bank at the mo to be playing hard ball with claimants - or am I just being a born pessimist?2014 Target;
To overpay CC by £1,000.

Sorry I havent updated for a while
Barclays have now submitted a Defence against my action (£4k) on the grounds that I agreed to their T&C's. Its a very poor defence and they dont address the fact that their charges are unlawful.
Tomorrow I will be filing my Allocation Questionnaire with the Court & sending a copy to the Bank.
Next step will be waiting for a Court Hearing Date0 -

Nothing more you can do during this stage but keep reading the threads & swoting on everything in case it gets to court. Its all a game of chicken and Natwest will be waiting for you to back down first. Barclays are also trying to play hard ball.0 -
