Sorry I haven't read this thread as its huge. Can you claim back charges on accounts which are now closed? My Dad paid a fortune in babk charges with a failing small business. I joined the Consumer Action Group Site yesterday but its alot to take in at first. Many thanks,

Yes you can. I know its a lot to take in but the CAG is a great website

Hi all, I' a bit confused now

I have made a claim for 1077.77 against Lloyds tsb,

    Date of issue 6/4/06
    served 11/4/06
    Acknowlaged 18/4/06
    Deadline to reply 25/4/06

Just called money claim and was told that LTSB have another 14 days, I thought this was only if they applied a defense (says this in CAG step by step). I checked on the moneyclaim site and it the JUDGEMENT box said START.

Not really sure what to do now, do I wait until the 9th or apply now?

    Please help

Give them a ring and ask nicely for a refund, if they refuse then take a look on the Conusmer Action Group webstie and follow the Step-by-step instuctions.

Because they have filed a Acknowledgment they have 28 days from the date of service to issue a Defence.

You wont be able to apply for Judgement at this stage.

Does the amount make any difference or leeway in these cases? For example, the DD was for £2.90 and there was £2.15 in the account and yet the charges are going to be over £50!

No it wont make a difference. If you go 1p or £50 overdrawn, the charges are still unlawful.

There is a lot of discussion here from people who are claiming back large sums of money. I am hoping people who have been faced with small charges will also do there best to reclaim the money.

I have only once been charged for a returned direct debit: £39 by Halifax and £25 by Amex. It has taken almost four months but I have now had these charges refunded in full. Amex were the hardest but I got there in the end.

So please, if you have faced even one small charge consider taking the time to reclaim the money.
