Just want to add (as you may have seen the thread in the debt free wannabies section) that i have sucsessfully recovered my money (320) + interest (114)+ court costs (50) to the sum of just under 500 quid.
As for anyone who questions the fight against the banks, they are obviously banking personnel and should be ignored
This money isnt technically legally theirs and they make so much profit on these charges it is unreal
Fight the banks!
Also one women on the support line from the halifax said "if everyone did this he bank would go out of business" and i said that would be a good thing0 -
You can go to the court - I believe that they will accept cash (although if the amount is over 1500, it's more expensive this way).0

So it's ok for them to drive people out of business? - but not ok for them to be driven out of business because they can't operate within the law. You should have reminded her of the Worldcom fiasco. Remind them what happens when big businesses operate outside of the law.

Just keeping an eye on this thread now, as many of you will know about my success with the co-op and getting my £1300 back in January. Made a bit of a co*k up last week an item that would have taken me £1.77 over my £100 overdraft limit if it was paid resulted in a £35 charge. I just wrote a letter, pasting text from my original demand for £1331.50, and within 48 hours £35 back in my account.
Whilst I agree wholeheartedly with dchurch's comments about having to weigh the pro and cons of maybe getting to court, do not let this distract from the unlawfulness of these charges. Clearly we have the banks on the hop, and the pressure must be kept up to get them to rescind this manner of charging.
I notice a couple of posters have had replies from their banks referrring them to the Banking Ombudsman. This is just a bunch of toothless tigers, if I were to receive this letter from my bank, I would just write back and say, thanks very much but I will let a court decide about punitive fines and breach of contract.
It is all about letting the bank see you are serious and not being fobbed off.

As a kinda new kid on the block my mum reffered me to this thread after being upset with more bank charges, now after being over drawn for 2 HOURS i was charged £23. Now im only 20 years old and may not have the wisdom of the rest of you lot to write the letters required to take the banks to town, i was wondering if someone could kindly point me in the right direction to (if any) template letters for taking action against the Clydesdale Bank, whom seem to have incompetent staff in my area (Wick, Caithness) I have read through numerous posts and would like to wish all that are taking action the very best and those who have a well done!!! All and any info is greatfully appreciated!!money.....gimmie gimmie gimmie!!!!0

Good luck with your fight against the Clydesdale - I too am trying to get charges back from them (Yorkshire Bank) and have had to file a claim online via the Small Claims Court! They even refuse to supply me with details of the charges that have been applied over the last 6 years :mad:

Well i don't think a lot will show up on mine but bearing in mind the appalign service I have had recently from Lloyds thn I'll fight for every penny they should never have taken from me to start with! I have been with them for 8 years if not more (since before I left school!) and had ALL my banking with them out of loyalty. I have had 3 loans over the years with them, credit card, current account, and my business account was with them too! Well When I went to re-organise my accounts recently and wanted to change my loan as I wanted to replace my knackered old car I had so much trouble because as a business customer I needed to deal with my business account manager even if ti was a personal matter. Well after about a week of phoning and chasing and never getting call backs, HUGE differences in the aprs etc I somehow managed to get the number for the head office in London and the names of a couple of high ups. So being the cheeky cow I am I called them and asked for them by name... and got through! From speaking to them to getting a call back by the branch manager was approximately uhmmmm 30 minutes
Complaining paid off but I was so fed up in the end I have been working on leaving Lloyds ever since. Credit card is now an Egg card and the Lloyds one closed. My Loan is with Egg and my current account with alliance and Leicester is up and running just waiting for my card and my internet banking ID
Once I get that I'll transfere the DDs I wanna keep from the Lloyds account and tell them to close it
So I wanna make sure I get the money back they have had off me over the years! I think I've earnt it in faffing about wasting time due to their incompetence!

If your bank refuses or ignores your dpa request and you then make a complaint to the I.C what happens next? How can you proceed with your claim without a figure? When you send the refund letter to the bank you need to state an amount or do you just bypass that bit and go straight to money claim?0
