Press article this morning suggests it is going to cost the banks £1.2 billion in lost fees per year but I guess it will prevent these small claims if a government department says that they are fair in principle, although I guess on a case by case basis, people can still demonstrate they do not reflect the true costs under contract law.

The 'Leak' I think was Stephen Hone at the BAG protest outside the OFT talking to a reporter and mentioning that he thought that the OFT would do something like that.0 -

Probably not! They don't want to send you copy statements for just £10, they would want to make some money from you! I expect the Legal and Public Affairs area would just send you copies of things like your application form, any other correspondence you have sent to them etc.
Contact them again and ask for a list of all the charges that have been applied to your account. They don't have to supply actual copy bank statements under the DPA (as confirmed to me by the Information Commissioners Office recently), but they do have to supply you with details of charges applied to the account. This could be in the form of a list or even a computer screen printout.

They seem pretty high so I'm sure they would be classed as punitive charges. It may be worth giving your bank a call to ask for clarification on what the usage fees represent, or check your Terms and Conditions...?:heart2: Tabs :heart2:

i wanna thank everyone here. after being charge £25 for late payment on a credit card, my OH complained and halifax/amazon just rolled over and refunded it. only complained with thier form for 250 words but we maanged it. not a lot but quite a relief really.
ive been charged over £500 for a student current account at the halifax which has now been totally closed and has been for nearly 2 years. should i claim this back? i could do with the money but im not sure if its really viable on an account closed so long ago...:A Boots Tart :A0 -

Also by entering a higher claim amount this means that you have to pay higher court costs. If it gets the ball rolling I don't mind as I will get it back
One last question, NatWest have now issued me with a default notice for my o/d since starting this claim, would it be a good idea to make a repayment arragment with them, get this in writing then continue with my claim or should I continue with it anyway as I can ask for the default etc.. to be removed if they settle or go to court?

NatWest have been really difficult (no dpa and a default notice!), but don't be put off they are just having a tantrum as they know they can't win. They can default me if they like as it will only have to be removed anyway. Good luck with your claim and stick at it no matter what they throw at you (and they will throw stuff at you) but keep smiling as you will be the one who laughs last :rotfl:0 -

As long as the charges fall in the last 6 years then the fact that the account has been closed has no bearing on the outcome except that they will have to pay you by cheque instead of into your account.
Follow the same procedure as if the account was still open.
The money was taken from you unlawfully and closing the account does not alter that fact.0 -
