The wording on the contract is as follows:
3a Withdrawal
Withdrawal can take place at any time at the instigation of E/A or the vendor subject to 21 days written notice and prior to unconditional exchange of contracts in the sale subject to section 1 above ( this is just about sole selling rights and ready willing and able purchaser s etc) and a withdrawal fee of £195 will be payable by the vendor if the withdrawal takes place within 6 months of the date of this agreement.
3b After 6 months of this agreement has elapsed either the E/A or the vendor reserve the right to review the overall marketability of the property and either party may thereafter withdraw from the agreement subject to section 1

That's so annoying Pawpurs I know what you mean, we've had a couple of viewers do the same, they came in saying how the rooms are really much bigger than expected then told the E/A they wern't happy that the rooms were smaller than the brochure pictures !!!
We've had people try to complain that there was no garden or no yard or that the rooms (all dimensions quoted on details) were not big enough for them.
One lady asked if all the photos on the details were really true because the place looked so nice. I assured her that each room was photographed from the corner of that room and that the rooms were exactly as the picture.

It is hard to give an accurate opinion based on part of the contract and even with sight of the whole contract I would feel a little nervous even after all my time in the business. I am appalled with this blood (money) sucking attitude. My view would be that I would feel so embarressed, not to have sold, I would of let you off immediately - no notice and no fees.
I can only suggest the usual for these situations CAB, OFT, OEA and generally let the EA know you are taking legal advice and you will be making a fuss. How about complaining to their professional body if they are members NAEA.
Ask them to put in writing - email fine - exactly how they feel the contract entitled them to money when advice you have been given suggests otherwise. Well how are we all doing? Another weekend is nearly upon us, and the spring is in the air!
I Have a viewing for tomorrow lined up, so we shall see what that brings eh! Could be the one, you never know!
Lots of stress here at the house of pawpurrs at the moment, I need my luck to change!

I'm a bit of a lurker on this thread but just to give those selling some hope we accepted an offer on our house this week. After 14 long months (and a 22% cut in our asking price) we were amazed to finally get an offer. The offer was only £5k under our asking price (although £20k less than we paid in 2006) and from a cash buyer so hopefully all will go smoothly now. Off to look at houses this weekend.
We have certainly seen a lot more viewings here since Christmas and have had at least 2 a week (4 last weekend) most of whom were cash buyers (all proceedable as we asked the EA to only let proceedable buyers view for the last 6 months as we got sick of tidying up for buyers not in a position to buy).
Good luck to everyone else trying to sell, hope you all gets offers soon.

Woop Woop, I have another viewing coming tonight! I have been spring cleaning all day, and have planted up some pots etc, so the house is looking sparkly.

3 viewings booked in for Saturday morning. 10:30, 11:00 and 11:15 so they had better all be on time and not hang around for too long.
All are investment or 2nd home buyers so here's hoping.
