  • Thanks Jazzy_B!

Have checked post 78 and will give it a try...
  • Seems to me that banks are just making this up as they go along. Some VISA card issuers have paid out immediately. Others, like MBNA, are telling customers they cannot process claims until after the return date of booked flights. This, of course, is just nonsense, given that Zoom will not be flying anyone anywhere! A delaying tactic, pure and simple.

I have written to MBNA, telling them that I expect a refund immediately. I'll post their response here.
  • I called Abbey to request a chargeback but was told they would need confirmation that ATOL will not pay out. I advised the agent that ATOL only provides cover to those who have booked through a travel agent. Even if I had booked through a travel agent, I would have to speak to them about the claim and not ATOL. He was having none of it and just kept repeating contact ATOL. I went to my branch and they filled in a dispute form which I recieved today. The form implies that my card has been used fraudulently and I have to confirm that I have had no dealings with Zoom. I am just going round in circles and no one at the bank seems to have a clue.

I'm in the same situation as you. Was stranded in Canada. Applied through chargeback and am still waiting for a reply. (originally paid with Barclays Visa debit card)

I just wondered if anyone knows the answer.

I was left stranded in Canada with Zoom and I have applied through Chargeback to get my money back, but I just wondered if anyone in the same situation has received half or all their money back?

    Thanks
    Kimberley
  • Has anyone received a refund from MBNA VISA yet?

They've given you the wrong form. You need the non-fraudulent claim form. You're in the right here. Stick to your guns and keep asking.
  • We flew out on Zoom to the States mid-August and were booked to return on the 1st of September but had to buy return tickets on another airline to get back, which came to around £1777 for three people. Following the advice on this thread. I applied for a refund and under Section 75 of the credit card act for the additional expense of my return flights. I just got a letter from Nat West Visa saying that the return part of my flight will be refunded but the additional expense is still be considered.

I was surprised to see Jenette not only received a full refund but also the holiday which she had yet to take.

When I spoke to the people at NW who were dealing with my claim he told me they had to apply to Zoom's bank to get the money and the letter regarding saying I got the refund for the return part of our flights also said that 'your enquiry has been submitted to the retailer's bank, in line with our membership of MC/Visa International who will assess your case and correspond with the merchant as appropriate...it may be necessary to return to you at a later date should our actions be questioned or if further information is received'.

    Therefore I wait in hope.

There is an update on the Zoom website www.flyzoom.com with regard to the Allbury Group being appointed to assist passengers and work with credit card service providers.

Also on this website it confirms that flights between Canada and the UK were operated by Zoom Airlines Inc which was based in Canada. For those people who are now trying to get a chargeback on their Maestro Cards this information may assist following on from Maestro's statement to the BBC Working Lunch programme http://news.bbc.co.uk/1/hi/programmes/working_lunch/7593369.stm where Maestro have stated there is an exception for UK cardholders ordering goods from an overseas website, although I expect that it will eventually be a decision from the FOS that decides this matter.

    Good luck with your claim.
  • Halifax have provisionally refunded my Zoom transaction, but they said the decision of visa or the creditors (I forget) would take up to 3 months and if they decide I don't get a refund they will simply take the money back out of my account.

This seems ridiculous to me. I'd rather them wait for the decision before giving me the money. It will be quite difficult to manage my English bank account whilst travelling around Canada!
  • We flew out to New York with Zoom and came back with Virgin for $300 each (thank you Virgin for bailing us out). We paid £250 for each of the Zoom flights with an Abbey visa debit card and I applied last week for a chargeback using Martin's instructions. I was expecting only to receive half the original cost of the flight as they had at least got us there but within 3 working days, we had a full refund of the cost of the return flights.sport-smiley-001.gif So our return flights to New York in peak season have cost us $300action-smiley-033.gif
    Thank you very much Abbey
