They are both Contracts that come under the relevant Contract Law. The relevanve here bein whether the charges are justified or punitive.
I have said i have no problem paying a reasonable admin charge but dont see why I should pay through the nose because some people (not me) sell the tickets on after prices rise.0 -

Haven't read through all 3 pages, so soz if opinion is same.
Think you'll have to pay the difference, because you ticked to agree to the T&C's at the time of purchase, even if the T&C isn't legally enforceable per point, I'm guessing you entered into another separate contract at the time of pressing submit, and unless you're medically unfit to do so, can't see what reason you'd have for getting out of it???

Firstly, PJB, there has been no ruling in the bank charges case which states that "£12.50" or any other amount is a legal or acceptable charge. There has only been a ruling that bank charges are subject to assessment as to fairness, not a ruling that their present level is unfair.
So your premise of using bank charges as a basis for your "unreasonable charges" claim is entirely false.
Secondly, the reason that the difference in fare is not what you see online, is that the replacement fare is the phone fare, not the online one. And therefore the difference is greater. As you have yourself stated, it's apparently possible to change names online and if you'd done so, presumably the charge for difference in fare would be lower. (I'm assuming that you have phoned to attempt to change the name, as you haven't said otherwise).
Thirdly, the charge isn't an unfair penalty (one of the arguments used in the bank charges case, and which has failed, at least as far as current bank Ts & Cs is concerned), because it isn't a charge for a breach of contract. It is a charge for the privilege of altering the name on the ticket. There's no earthly legal reason why they should allow you to change the name on the ticket at all - the legal position is that you have booked a ticket for yourself, which you don't want to use (because you've bought another, but that's totally irrelevant).
The "change of name" charge is a charge for a service you are choosing to buy - not a charge contractly forced on you by the original contract at all.
Just because you take EasyJet to Small Claims Court doesn't mean that you'll win by default. If your argument is rubbish, the judge will simply kick it out.0 -
Just to clarify regarding the "fare difference", they say it is £50, but according to their website they have tickets for sale that are only £25 more than what i paid.
This is i would say another example of them being unreasonable and possibly alot more.......0 -

Thank you for your constructive advice/opinion, this is what i have been asking for. I do accept the differences in the way you point out and had not previously grasped this.
Can a term not still be unfair and therefore unlawful even if it incurs a charge for a service, that as you say is not contractually forced upon me?
I would say that mistake is a good reason for them to allow a name change at a reasonable expense.
Yes i did try to amend the boooking online and the prices i have stated are those that this returned, exclusive of charges.0 -

PJB, Can't you just hold your hands up because you know it's you that made the mistake, NOT Easyjet.
Surely once you had filled the forms in, you can see everything throughout the process once more before you submit?
If you make a mistake, you have to pay a price to get the details amended.
Come on, how hard is it to type a couple/few names into the boxes and how hard is it to check everything over before you pay?!Tank fly boss walk jam nitty gritty...0
