    i ordered like many people yesterday because of the 75£ voucher i do accept that their terms say they can withdraw a voucher at anytime but my shopping bill was 39.59p they invoice said 5.50p for delivery only recieved the order signed for it, then had a look at my bank account it showed that asda had taken 80.50p out of my account leaving me with 96p in the bank, as you would expect i rang them to complain and was told i'd have to send them a copy of my bank statement to prove that asda had taken the wrong amount out ie over 40pounds more than they should have before they will refund me i pointed out to them that i had 96p left in my account, the halifax want 6 pounds for a full statement also i had no electricity left and no funds to buy more also no money to get to work tommorow and was appaled that i got no apology from them or an explanation as to why they have taken the wrong amount, asda have now left me with no electricity to cook the food i had ordered, possible job loss if i dont turn up tmw (no bus fare left), no apology, i will never use asda again i will rather shop at waitrose and pay double than use asda their customer service STINKS TO HIGH HEAVEN, they have left me at my wits end with what they have done through no fault of my own, anyone any idea's as to what i can do i'd be most grateful
    Wow, that was quick that your account was actually debited straight away. I order from tesco and although they put "holding" payments for my groceries they don't actually show online a couple of days after delivery. Are you sure it was not a holding payment?

    Your protection when shopping online

    Under the E Commerce Regulations (Electronic Commerce Regulations 2002), online shops must set out the stages you have to complete to place an order. You must also be given the chance to check your details before placing the order.
    If the online shop confirms acceptance of your order, you have a legally binding contract, but you don't if it just acknowledges your order.
    The E Commerce Regulations also state that the online shop has to give full details of who they are and provide a geographical address and an email address at which to contact them.
    Online shopping: terms and conditions to watch out for

    An example of an online shop's terms and conditions to watch out for is when they say that the price of your order will be fixed the day the goods are dispatched to you.
    This may mean that the online shop may charge a higher price than when you placed the order, but the online shop must give your right to cancel under the Distance Selling Regulations.

    They will not have actually "taken" the full amount. It is just that you have used your card for what is that amount (as the evoucher has not been confirmed or otherwise yet). Once the shopping is delivered and the evoucher is confirmed then they actually charge you (and are only allowed to charge you) the amount on their invoice. Only then when its delivered does the contract actually begin. You have accepted their offer to buy goods from them for a price on your invoice.

    I made my order a couple of days and accepted the e-voucher in good faith. Received confirmation email and my order was still showing on asda.com.

    No email or telephone call to let me know if there was a problem so I presumed all was ok and I was going to get my week's shopping.

    The delivery man came and wanted £87.79. I showed him the confirmation email and also my account orders on asda.com and he game me a number to call. When I spoke to the store manager I had the phone put down on me once and then when he listened to my points he agreed with them all. This is leaving people out of pocket.

    So much for the bl00dy richeous adverts on the television.

    I have now made a facebook group to try and get a resolution for all of the honest people who have been scammed by asda so I would be really pleased if you would all join :)

    So most of us now have either had to pay the extra money or have no weeks shopping and are out of pocket. This is not fair and something HAS to be done.

  • I cant understand why my halifax account has only the 96p in it if they had only taken the 39quid they shudda done i would be able to withdraw the other monies outta my account ie 40quid or so remaining but unfortunatly i cant it keeps saying no funds available to withdraw witch must mean that asda have charged me the full 80.50p and recieved it from my account the halifax have confirmed this too i am hopping mad but thank you for your prompt reply it is much appriciated as a newbie i appologise if any ettiquette has been broken by me but i am hopping mad about asda and will never shop there ps i have also sent my story/rant to watchdog on the bbc in the hope that they pick it up and put it on their show

    I would suggest printing out a mini statement or check online (if you do online banking) to determine the figure and then contact Halifax and explain to them what has happened.

    I working in the banking sector and this is FRAUD. You have agreed that they can take x amount so they can not charge you anymore unless you sign or verbally agree.

    I hope they sort it out for you.

    I am personally in the boat where I have hardly any food in the house now, and because ASDA have reserved the money on my credit card I do not have enough of a credit limit left (it's been an expensive month!) or the time to go to an alternative retailer to purchase all of my weeks shopping again.

    ASDA should be made to honor their promises.

    What happened to all of that 'price promise' !!!! anyway? :mad::mad::mad::mad::mad:

    As per Asda's terms and conditions there contract only begins once the shopping has been delivered.

    The only real argument that people can have with Asda is IF they had their shopping delivered and received an invoice for one amount with the voucher being validated and shown as validated and then asda take the full amount. This would be classed as misleading you or maybe misrepresentation. There are laws that would cover this I am sure. IF however they do not deliver and you have a confirmation email to show then you really have no rights as Asda have in their terms and conditions that they can withdraw vouchers at any time (but your statutory rights and contract rights would kick in AFTER delivery as the contract is then accepted) and refuse delivery.

    Also Asda have not actually taken your money, your bank has reserved the money in case you go ahead with the contract. This is held on account until cancellation and can take a few days to reverse.

    This is how I would see it and argue it.

    I placed an order yesterday morning using the £75 "win" evoucher and phoned to check it was valid....was told it was. I then phoned back yesterday afternoon after reading some of the posts here and was told that it wasn't valid and that they would be charging me £80.50 I complained and said I had accepted the voucher in good faith and that I enter a lot of online comps so had no way of knowing it was glitch so they should honour it. They refused so I cancelled my order and emailed (well used the pathetic contact form which only allows for 1000 characters so pretty useless)

    I pointed out that they could have caused me or anyone else who had used the voucher to go overdrawn because they would be charging more than agreed when the order was placed. I also said that adding a "fake" evoucher to peoples account then charging them full price could be considered fraud.

    This is the really "helpful" reply I have just received.

    So basically they have totally ignored everything I complained about :wall: oh well back to tesco it is....I'd only just started using them again after a problem I had earlier in the year, should have known better.
