I also had the voucher and when my order was delivered, the advice note I signed for showed the £75 deduction. However 30mins later the store called me to say it had been a mistake-a systems error! As I had no chance to decline the order and signed for receipt of the order at the reduced cost, can they still take the extra £75. This just doesn't seem right!0

Had exactly the same happen to me, someone on one site claims that as it was delivered thats when the contract is completed so they then cant claim the money back (prior to delivery he says they can ask for more) not sure how legit this is though. They haven't taken the extra money out of my bank as yet but I guess they will0 -
I ordered yesterday, the £75 discount appeared, shopping was delivered this morning showing the discounted total on the delivery note. I don't see how anyone can charge money to my credit card without my signature or agreement so cannot see how Asda can take this back. I haven't had a phone call.0

I agree. I received my shopping at 10 a.m. and the invoice showed the £75 voucher reduction, signed for the shopping, put it away. Got a phone call three hours later asking me to return the shopping or pay the £75. I refused both - have even used some of the groceries! I've told them they are entitled to charge only the £36 on the confirmation statement as this is what I signed for.0

did my shopping online came to £9.25 with my £75 off delivered this morning got delivery note saying £9.25, money gone out of bank for the order placed dont see how they can charge you twice for the same shopping. Is it legal for them to do that?0

I have a question, the delivery note is also a VAT reciept as far as i am aware this constitutes a contract for the amount printed. My £75 off gives me a total balance of -1.28 as some items were not charged. If asda take more than this have they breached the contract?0

I got my shopping delivered today at the reduced price and also I signed to "accept" the order on a paper that the delivery drive had with everyones name and address on but no mention of price. If they try and charge me full I shall be using the following

Pricing
It is actually a criminal offence for a seller to provide misleading information on the pricing of goods or services. All hidden costs must also be included in the final price, or made clear on the advertisement, with written confirmation provided to the consumer when purchasing an item.
What to do?
If you believe that you have been subject to misleading advertising online, your first port of call should be to check that the website is UK-based, and then contact the online retailer. If this does not resolve your complaint, then you can try contacting the UK government's online consumer advice centre, Consumer Direct. You can also make a complaint to the ASA, who may investigate or refer your complaint.
If you believe that a financial service provider is using misleading advertising, then you can use an online contact form to inform Financial Services Authority (FSA).

Our Contract
2.1 Our Website invites You to buy goods from Us. Once You have placed an order on the Website We will send You an order acknowledgement by email setting out what You have ordered with the in-store prices on the day of order. This is not an order confirmation or acceptance from Us. A legally binding contract with You will only arise once We have completed Delivery of the goods to You. At this time You become the owner of the goods. This means that You will have no legal liability in connection with Your order until Delivery is completed.
2.2 These terms regulate the supply of goods to You by ASDA. Any other terms, conditions or representations (other than those made fraudulently or implied by statute) are excluded.
2.3 The failure of ASDA to take any action in respect of a breach of these terms and conditions shall not constitute a waiver of their enforceability. ASDA reserves its rights in respect of these terms and conditions at all times.0 -
Same here - I spoke to nice people at customer services and got my delivery fee refunded. I have refused the offer of a £5 evoucher (after all, they might just grab that back from me if they feel like it) and I've written a polite letter to go over to their complaints team, seeing if they can make me a better offer.
I've suggested £40, since that's the difference between my normal weekly shop (£70) and the £110 I spent this time round to do a two week shop in one go. We'll see what they come back with on this front. Yes, I know that the T&Cs say we can 'get rid of a voucher at any time', but I've mentioned that I feel they may have deliberately applied this to people's accounts in order to get them to spend more, then call them up an hour before delivery to hold them to ransom. We shall see---reech!

Sorry -extra posts since I refreshed
I was looking at the thread earlier while writing the letter.
The electric pad from the delivery guy gave the FULL amount, so I signed that as 'price query, goods accepted' and I'll be contacting the head office this week. The printed receipt showed only the lower amount total.
For those of you who received it and signed at the lower price - you are contracted to ASDA for that amount, according to their T&Cs. You'll not have to pay anything extra, since at point of sale\delivery, you accepted the lower price, which is what their T&Cs hold you to. However, read below...
I'll have more fun and games trying to get them to pay me something, since when they were delivered to me it was for the price 'without the deduction', which is why I've gone for a compromise payment in between the full amount of discount i was originally entitled to, which they then decided on delivery that I wasn't entitled to.
So, about those T&Cs, and how to deal with the pesky arguments they'll come back with about their right to whip 'em out at any chance they have...

---So, that shows that what you signed for, you paid for at the price they charged - HAH! But what's this...
"2.3 The failure of ASDA to take any action in respect of a breach of these terms and conditions shall not constitute a waiver of their enforceability. ASDA reserves its rights in respect of these terms and conditions at all times."
--- SO this changes the above. i.e. Yes, they charged the lower price, you signed for it, but because we made a mistake that was in YOUR favour and against ours, we shall enforce the right to claim extra payment. Gits.
But so saying, that means that if they claim for those that agreed at the HIGHER price that T&Cs 'must always apply', you can point out 2.3 that they can *choose* to ignore the T&Cs for those with the lower price - so if they're going to ignore them to claw money back, surely they can choose to exercise them to be nice and compensate you? Admittedly yes, we understand it was an error, but we had no way of knowing it wasn't right, and we didn't take advantage of it because it was an error - I was just doing my normal shopping! We'll see.---reech!

i ordered like many people yesterday because of the 75£ voucher i do accept that their terms say they can withdraw a voucher at anytime but my shopping bill was 39.59p they invoice said 5.50p for delivery only recieved the order signed for it, then had a look at my bank account it showed that asda had taken 80.50p out of my account leaving me with 96p in the bank, as you would expect i rang them to complain and was told i'd have to send them a copy of my bank statement to prove that asda had taken the wrong amount out ie over 40pounds more than they should have before they will refund me i pointed out to them that i had 96p left in my account, the halifax want 6 pounds for a full statement also i had no electricity left and no funds to buy more also no money to get to work tommorow and was appaled that i got no apology from them or an explanation as to why they have taken the wrong amount, asda have now left me with no electricity to cook the food i had ordered, possible job loss if i dont turn up tmw (no bus fare left), no apology, i will never use asda again i will rather shop at waitrose and pay double than use asda their customer service STINKS TO HIGH HEAVEN, they have left me at my wits end with what they have done through no fault of my own, anyone any idea's as to what i can do i'd be most grateful0
