IB stopped due to NI mistake

Stazi, I asked them to convert them and they said they cant because 3 months were voluntary.
I don't know where the P60 is and if I have it at all.
my first NICO payment was Sept 99
My self assessment tax 99-2000 income was £5732 and my tax bill was £139
my tax calculation from the tax man 00-01 was total income £2759 no tax to pay.
I really have no idea what it is I'm actually looking for?so near yet so what.....0 -

99/00 As you were self employed for the whole year , then you were liable to pay Class 2 not Class 3. Insist they convert them from 3 to 2 - if they refuse- ask them to tell you why - and what Regulation says they can't.
00/01 Can you remember who you worked for? Is this employer still trading? Do they have any records back to 00/01? Do you have any payslips/bank statements?
Remember, you're only looking at NI not Tax for the above years.0 -
Shortfall in National Insurance contributions as a result of a mismatch of information between Department for Work & Pensions (DWP) and HMRC
We have checked our National Insurance records and a small proportion of records were found to have a mismatch between the information on the DWP and HMRC computers.
We had wrongly recorded incapacity credits (for periods where an individual is unable to work) and in some cases credits for an approved training course. This has now been corrected but it does mean that some individuals have a shortfall in their contribution record for certain years. We are issuing letters to these individuals.
If you receive one of these letters and you believe that the information we have sent you is wrong. You must write to us at the address shown on the front of the letter. You need to include your National Insurance number which is quoted on this letter, or you can phone us on Tel 0845 915 9555, Monday to Thursday 8.30 am to 5.00 pm and Friday 8.30 am to 4.30 pm.
Shortfall in your National Insurance Record
You may receive a letter from HMRC inviting you to consider paying voluntary contributions (Class 3). This letter is issued to alert you to the fact that you have a particular tax year that will not count towards basic State Pension and Bereavement Benefit – it will not be a 'qualifying year'. Letters like this are issued to certain people every autumn. This year, letters will be issued from September 2007 until January 2008 covering the 2005-06 tax year.
This year, the arrangements for issuing letters are slightly different, to take into account changes to pensions and pension forecasting which have arisen as a consequence of the Government’s Pension Reforms, which take effect from 6 April 2010.- If you reach State Pension age before 6 April 2010, your letter will alert you to any shortfall in the 2005-06 tax year, and will include details of the 'qualifying years' up to and including the 2004-05 tax year. This extra information will help you decide whether or not to pay voluntary contributions.
- If you reach State Pension age on or after 6 April 2010, (and have no periods of Home Responsibilities Protection (HRP) on your record), your letter will alert you to any shortfall in the 2005-06 tax year, and will include details of the 'qualifying years' up to and including the 2004-05 tax year. You will also be given some information about the changes to state pensions which come into effect from 6 April 2010. This extra information will help you decide whether or not to pay voluntary contributions.
- If you reach State Pension Age on or after 6 April 2010 and you have Home Responsibilities Protection on your record, you will not receive a shortfall letter this year. This is because the arrangements for Home Responsibilities Protection (HRP) are changing as part of the Government’s Pensions Reform. HRP will be converted into a new weekly credit and most people will benefit from this. We will let you know following this conversion if you had any shortfall in the 2005-06 tax year, and make sure you will still have time to make up the gap if you want to – you will not lose out. There is more information about the Pensions Reform and HRP on The Pension Service website.
If you think you should or may be entitled to National Insurance credits for the period on your letter, you should read the information about National Insurance credits as it may help you to decide. If after reading the information you think you should have received National Insurance credits, call us on Tel 0845 915 5996 lines open Monday to Friday 8.00 am to 8.00 pm and Saturday 8.00 am to 4.00 pm, but if the benefit you received during the period covered by the letter was one of the following:- Incapacity Benefit
- Industrial Injuries - only if this benefit included an Unemployability Supplement
- Jobseekers Allowance
- Maternity Allowance
- Severe Disablement Allowance
If you were caring for someone and your letter does not show that you were in receipt of Home Responsibilities Protection, you should read the additional information about Caring for Someone.

They said I wasn't self employed between 5 Apr - 1 May 99 but was from
2 May 99 - 5 Feb 2000
Class 3 was paid for the 11 weeks shortfall.
I don't understand because I was paying an accountant fromAprill 99
Tax yr 00 - 01 11 weeks voluntary
I really don't know remeber what was happening then, but I do know I was hospitalised with kidney failure but can't remember the dates.
Like I say, it's a mess and those 24 weeks are making me pay.
I have no redress, and no way to ask for someone to be kind and help me live.
The rules are there and I can't deal with it.

My OH has had a similar experience, he has been in receipt of benefits due to his illness for about 20 years, it came to light a couple of years ago that he had no record of NIC for 10 of those years, they have just vamooshed. It's been investigated, we even had our MP involved, but to no avail. He gets IS instead of IB because of this, and we were told not to worry to much because any pension would just be topped up with IS, i'm not sure if this is right but there does'nt seem to be anything we can do anyway.

I can see the accountant has gone through it all with a fine tooth comb before my PAYE employment and I'm still scrambled.

They said I wasn't self employed between 5 Apr - 1 May 99 - Tell HMRC this is wrong, tell them you were S/E from the start of Apr 99, tell them the moon is made of green cheese, but tell them. If you were S/E and you(or Acct) have some evidence(reciepts/bills/orders)- tell them their records are wrong- don't take no for an answer. If you were S/E then you were LIABLE to pay Class 2 not 3.

From your P60, what were your earnings, and what did you pay in NIC?. Make sure that HMRC have these earnings on your record for this year.0 -
Becky, you have to explore all avenues, I know its hard, but had I thrown in the towel and accepted their decision I wouldn't have got it reinstated.
Its sounds like you may need this escalating in the HMRC to your own NI individual caseworker, who can also go through all records of yours with a fine tooth comb.
Go back to the HMRC and ask that it be passed though to an individual caseworker for NI's- Room BP2202 , Benton Park View Newcastle NE98 1ZZ
Remember my battle was firstly, I didn't even have my own NI number, part 2 nightmare was trying to convince them I even worked!.. at least you have some proof to work with, whatever the outcome, you'll never know unless you try to get the right answers for you.. keep going girl, you've got your own battles to cope with as I had, but find the strength to explore everything, and win just one more:T
