IB stopped due to NI mistake

    I just feel so lied to and so led up the wrong paths... told pay short fall and u'll get IB.

    I payed the shortfall and the tax people said there was no shortfall left to pay. I then apply again for IB and get told again no because they are now paying the NIC.

    So I still don't get benefits to live, eat and pay bills that life brings as we breath.

    I suppose I could stop eating, as my DLA is for care not food or gas or electric or mortgage.

    My patner pays everything so I may aswell sign the property to him as theres no point in name only.

    I really could do with 'How to' advice. Who do I write to? how can I be heard?

    What do I do?

    p.s I was paying class 2 NIC before I was PAYE. The shortfall bill was based on 4 yrs before dx.

  • What a terrible situation to be in!

    When my husband fell ill last year after working since age of 16 and for the last 10 years for the same company, we have had the hardest time getting benefits. As we never claimed anything (except tax credits), we were completely clueless how to go about it. Firstly, we had a little put aside for Christmas, so I was using that while it lasted and then applied for housing/council tax. We were refused and it took a year to sort it all out through appeals! At one point I only had enough coinage to choose between milk or half a loaf of bread for all of us (we have 2 young kids). I started using credit cards heavily :/ Our incomings were less than what I had to pay in rent and council tax and if I didn't pay, they sent sheriff court officer to the door! And we never owed before!

    When it was time for IB, it turned out NI is missing records for two years of my DH employemnt - two out of 10 years!!

    I would strongly recommend trying to find Welfare Benefits Advice service in your area. After we got help from them, they fought battle after battle and won them all!! We also got DLA and CA as my husband needs care and I had no idea previously about this at all! No one expects or plans to get so severely ill.

    Good luck, everyone. It is shameful that in people have to struggle in poverty after paying their contributions. Illness is stressful enough and having to deal with bureacracy causes so much stress, which is not good at all!

    Councillors and MPs were also useless in our case. They just asked council and took their word for it. They represent council, not people :(

    Becky, do you have any adult children at home who can claim carers for you? Also I thought you could get income support if you don't have the credits for IB have you looked into this?

    I get the impression that her partner works full-time so she would not be entitled to IS instead of IB.

    To try and understand the NIC problem, it would be helpful if you could just answer the following-

    1) When did you first claim IB from?
    2) When were you S/E - from/to
    3) When were you employed? - from/to
    4) What years did you pay Class 3 voluntary?
    5) Who told you if you paid Class you'd get IB?

    So very glad to hear that the op got this sorted in her favour-well done you. I'm sorry I misunderstood that you had actually paid the contributions,the way I read it you hadn't but no matter now-any chance of compensation for all your hassle? Too much to ask I suppose but wouln't it be nice!

    Hi Stazi,

    1) dx Feb 2002. Working from Oct 2000 - Feb 2002 Paye. I tried to claim IB, that's when the shortfall was pointed out and IB was refused. It was suggested to me that if I pay the shortfall I would qualify. I paid it, went back, and was then told that it was too late. As I was a single person then, mortgaged and all the mortgagey things.
    I was given IS.

    I then meet my partner, 2004 and I write to the dept to say stop IS etc as he had moved in with me. That was duly noted and all benefits stopped.

    now here comes the complicated bit. The NIC before Oct 2000 shortfalls.

    1997-98 £36.30
    1998-1999 £175.00
    1999-2000 12 at £6.45 £77.40
    2000-2001 11 at £6.55 £72.05
    Total to pay : £360.75 (Paid 2002)

    I was self employed from 1997 - Oct 2000.

    I understand from the inland revenue I was paying Class 2 contributions.

    I was in hospital for some time 98-99 with kidney failure so wasn't working for some of this yr.

    I then for some reason get an £80.00 rebate from the NIC agency in 2001.

    When I was PAYE I was given the wrong tax code.

    Finally, I was told by the benefit office I was dealing with at the time that if I paid it, then reapplied for IB in a few yrs, that I would get IB.

    I am confused on so many levels, as I was told that only 2 yrs NI was taken into account but was told to pay all shortfalls.

    Oh Becky I am so sorry you also have had to endure this nightmare & sending you a huge hug !
    , did they ever explain the shortfall you would be paying as a class 3 would maybe go towards your pension rather than your IB?- that what I was told at the beginning of all this mess.

    Although my experience with the CAB wasn't a productive one, maybe yours will be alot better, so please seek advice as soon as possible, I totally understand your desperation, I have been there of late, and yes there are days I just thought " theres no point"... but please when you do feel like that pick up the phone and talk to somebody, I know you will have very dark days, only a patient with this illness will know much , how this affects us and our coping mechanisms.

    I am going to try and post up a copy of the contributions needed, sent to me via the DWP to explain the classes need to qualify.. if this dosn't work pm me, and I'll try and get it to you somehow.
    Please stay strong, I started to crack but kept going- god knows how, please don't let the establishments break you, you have enough on your mind with your illness, but seek help - please I can't bare the thought of somebody talking about Dignitas and the fact you don't feel you have value, you really do - look at the work you did - you are an angel.. bless you for doing that. Its your turn to get the help you deserve & need

    If you first claimed IB in Feb 02, then the 2 relevant tax years would have been 99/00 and 00/01.

    99/00 If you were S/E for the whole year then you should paid 52 Class 2 stamps. The 'value' of a stamp was then £66pw - £66 x 50 weeks = £3300. Check with HMRC that they are Class 2, and if not they are not-tell them you were S/E for the whole year and ask HMRC to convert the Class 3 to Class 2. Class 2 count for IB, but Class 3 don't.

    00/01 You were S/E up to Oct 00, so you should have paid approx 26 Class 2 stamps - 26 x 'value' of £67pw = £1742.00. You then become employed from Oct 00. Check your P60 for this tax year as you would only have needed to have earned about £1800.00 (26 weeks of earnings at a min of £67pw= £1742.00) every week for these to count.
    If your earnings were, on average, below the £67pw for these weeks from Oct 00 to Apr 01, then you would not qualify for IB.
