Re: Washing Machine from B&Q.
As pointed out in my earlier post sent 1st recorded delivery on my faulty washing machine that is not yet 2 years old.
Normal response 'wear & tear' blah blah.....no repair free of charge.
Sent 2nd recorded delivery outlining my rights again and my determination to get the repair and associated costs through the SCC.
No reply as yet and my wife is getting a little frustrated of going to the local Launderette :rolleyes:
I am today going to write my 3rd recorded delivery to their MD.
What would you suggest Art ???
Should I get the machine repaired and then go to the SCC, to claim for this costs including the costs of the Launderette ?
Even if they answer very soon and repair the machine how can I recover the Launderette costs ??
I do not have any receipts for the Launderette, but can claim normal family washing rates and have logged the costs, is that ok....???
How long should I give them after I have sent the letter today ???

You have been very patient on this problem. If I were you I would write, recorded delivery, to the MD and tell him that you will instigate SCC proceedings if you have not heard from him within 7 days. Also point out that because of the length of time you will get the machine repaired as you need to use it. Tell him you will also be claiming for all your expenses incurred during this fiasco.
As to the cost of launderette usage keep a log of the monies you are spending with the dates. In court the Judge will look at your claim and decide if it is reasonable.
Once the 7 days are up if you haven't had a satisfactory response from B & Q I would suggest you go straight to the SCC.

You don't say if this is a local company or one of the national chains you bought from.
Send a letter, recorded delivery, to the head office of the company. Give all the details of your dealings with the firm since you purchased your TV. Tell them that if they don't give you a firm date when a replacement will be delivered to you you will take them to the Small Claims Court. Tell them you give them 7 days to respond. If you haven't heard in this time start court proceedings.

On going Saga: B&Q Washing Machine
Family of 4 without a washing machine for over a MONTH !!!!
After one month of letters, all one way by the way from me to them, I finally called B&Q Office to see if they are likely to do anything in terms of repair.
If not then I would then instigate legal action against them.
B&Q have now said that they wish to send an Indesit Engineer to look at the appliance.
I do not expect to be charged for this call out, but we will see what they say when they fone back.
Now if everything goes well and the Engineer comes looks at the machine, deems it a manufacturing fault and then mends it free of charge I will be very pleased except...........
How can I claim back the Launderette and Inconvenience costs, does the route remain SCC or is it a hope that B&Q might wish to give some compensation ( wont hold my breathe ) ?
Any advice to protect my rights whilst this saga continues ???

B & Q can send an engineer if they wish but make it clear to them that they, as the retailer, are responsible for dealing with your complaint. Also point out in writing that you will expect them to pay all your out-of-pocket expenses.
Assuming that the engineer fixes the problem where do you stand on your expenses? Firstly, write to B & Q and tell them that you expect them to pay £xxx for out of pocket expenses. Give them a breakdown of your figure. Give them 10 days to respond and inform them that if you are not satisfied you will go straight to the SCC.
Before asking for expenses I would let the engineer call and do whatever he decides to do then write asking for the expenses.

We bought a printer from PC World in Feb 06. It stopped working in Dec 06. They agreed to send it to Epsom for repair. As this could have taken a few weeks we purchased another printer to use in the meantime.
They decided after a couple of weeks that it couldn't be repaired and gave us a new printer.
As we had a printer already we put this to one side and never opened the box until Oct 07 when the other printer packed up. We plugged in the replacement and it would not accept the ink.
I took it back to PC World and they said that it was now out of warranty as of Feb 07 and they wouldn't repair or replace it despite the fact that we could prove it had never been used and was obviously faulty when they gave it to us.
We are pursing this with them as after contacting Trading Standards they advised that we should be given a replacement. I am still waiting for a response!!
My question is, if you are given a replacement item should this now have a further 12 months warranty? or were the shop right in saying the warranty continues from the date of the first purchase.0 -

If an item is replaced under a warranty it is done under the original date of purchase and you do not get a new warranty with the replacement but simply the balance of any time left on the original.
As to the problem with the new printer, you could have a case under the Sale of goods Act by asking if it is reasonable for a printer to fail within the time scale of yours. (original date of purchase).
One thing to consider is the cost involved. Printers have come down a lot in price in recent years and a good printer can be had for under £60. Manufacturers make their money on the replacement inks these days. How much is a new printer of the spec you have today?
I would suggest trying to get it replaced under the 'reasonability' condition. If this doesn't work you could always use the Small Claims Court but you must decide if the value of the printer warrants this action.

I thought that might be the case.
I am still going to try and pursue this as we can prove it never worked when we were given it, even though we didn't try to use it until recently. You can see that the sponge inside is still clean, so i'm not going to let PC World get away with it even though the printer was only £60.0 -

Write to their CEO at the head office, recorded delivery. State that you hold them responsible under the Sale of goods Act. It's worth a try.
