Re: Indesit Washing Machine and B&Q

Family 4 without washing machine for 6weeks !!!

The Indesit Engineers called and repaired the machine free of charge as the 'Drum' was replaced previously some 11 months ago and therefore was covered.

Why oh Why B&Q didnt have the courtesy to at least try and resolve this issue at the very beginning and save me so much inconvenience, God only knows.

They found time to write evasive and legally incorrect letters, and fob me off and lie to me over the fone, but didnt find the initiative to speak to Indesit !!

Surely it was the responsibility of B&Q to deal with the manufacturer and not me !!

But I now expect some redress.

I was without the machine for 42 days in total. I think £5.00 a day for the inconvenience is reasonable. ( £210.00 )

The Laundry costs were approx. £4.00 per day on average. ( £168.00 )

Giving a grand total of £378.00.

Now how should I play this ??

Is it likely that they pay this amount without an appearance at the SCC ??

They are only risking the added Court fees whilst hoping that it might be likely that I wont go all the way to the SCC.

Anyway guys, I am not precious give me your best advice and thank you in advance.

    Matty,

Yes, it was B & Q's responsibility and a court will certainly point this out to them in no uncertain terms.

Write a recorded delivery letter to B & Q telling them that you expect full payment of your expenses within 10 days or you will claim through the SCC without further contact.

If I were you I would initially claim £10 a day inconvenience. If it then goes to court it will be up to a Judge to decide if this is fair or if he will reduce it.

    Regards,
    Art.
  • Could someone out there recommend a few department stores in Belfast who would provide gift certificates so I can get one to give to a friend there? There isn't a John Lewis and I don't know the names of any others. Any help would be appreciated. I am in London.

    THANKS.
  • Hi Art,

Not sure if this is the right place to post this, but if it has been unusually quiet in here, it might be that I was unable to get to this forum through my usual links and an e-mail to the administartor was unanswered, it took me all be a technophobe a couple of days to find another way.

Looked at the 'Sales of Goods Act' but it seems I have no redress ;-)

The redress is that the retailer has to put you back in the position you were in before the problem, hence your claim for expenses. Hope this helps.

  • Hi.

My washing machine is 6 months old, a beko bought online from comet. The first fault happened after a month, my clothes came out with a singed burning smell. Comet came around and said the door seal wasnt on correctly and altered this. This cleared the problem up, sort of, as my clothes do sometimes still smell if i overload it.

Anyway, from the very beginning my machine sometimes decided it didnt want to spin, i fixed this myself by taking half the load out and spinning seperately. Over the past 3 days, the machine wouldnt spin at all, not even empty.

I phoned comet and and engineer called this morning and would you believe the machine span. He wrote on the receipt that the fault wasnt there whilst he tested, but customer is not happy, and where i should have signed, he wrote customer would like an exchange.

    Well, yes i would..

He said it will be up to his boss to decide and if i havent heard anything then i wont get a replacement as his boss will more likely say, well it is working etc

My worry is, this fault is here, abeit intermittantly, i only have 6 months of the manufacturers guarantee left.

Can i insist on a replacemet? if so, how do i proceed

    Thank you

Sorry Art I did not mean that.

That was me being unsuccessfully funny, about not being able to get on to this site for a few days:o

I just wondered if you were aware of that problem........conecerning your site that is.

My action against B&Q is still ongoing and I will keep you updated.

Write a recorded delivery letter to Comet. Detail the history so far with the machine. Tell them that there is obviously an inherent fault in the machine and under the Sale of Good Act you reject it and want a replacement or your money back.

Sorry Matty I misunderstood your comment. The site had a problem recently and this made it impossible to reach. also it is always a slow site to navigate in my opinion.

BTW, it's not 'my' site. I just try and answer some of the queries on this thread. Hope Martin doesn't think I'm trying to hijack 'his' site

  • Thanks for your response
