Brought a TV in September from a company that sells ex-display, end of line, graded tv's.

tv developed a fault a couple of weeks ago, half the screen was white.

took it back 2 weeks ago tuesday for repair, told me to phone on thursday before last for an update, which i did, was told someone would call me back.

Same procedure followed until the following Wednesday when I got a bit grotty, and was told it was repaired and someone would call me back to let me know when i could collect. No one called. Phone back next day asking if i could pick it up on Friday because i was off work, and would make life easier. Arrived, was told i was getting a replacement. Same model, different tv.

So, friday evening, fine. Last night, turns off by itself, and standby led is blinking at me. Googled the philips blinking code but can't find anything on the specific pattern, but i assume something has gone on the board inside.

So this one has failed to last 48 hours.

Obviously i'm a bit vexxed, shouldn't have gone down the 'graded' route to start with. Lesson learned.

Am i within my consumer rights to phone on monday, and demand a refund even though i've let them 'repair' the product. Taking into account i was given a different tv (not the same one) and both have developed faults. THe second in less than 48 hours.

Even though the purcahse is now 3 months ago. I get a 12 month guarnetee but i don't want another graded tv for it to possibly die 10 months later and no longer be under guarnetee. Am willing to now go to comet where they have the same tv where i can purchase online and collect for just £85 more but at least i'll know i'll be getting something boxed and brand spanking new.

Help, As i'd like some material to quote if possible. At the moment i've got 'the goods are not of a satisfactory quality' and the 'the goods were more than likely inheriently faulty before i took them off the premesis'

Which i think works in my favour as it's been less than 6 month's since I purchased.

As I have no doubt this place just buys pallets of faulty tv's in from argos/comet etc fixes them up and resells them.

You are entitled to a fully working TV even though it was a graded model. Write to the company rejecting the goods as being ' not of satisfactory quality and not fit for purpose'. Demand a refund and tell the company that if this isn't forthcoming you will go to the Small Claims Court.

    Simple, easy one..

Bought a New Hotpoint Dryer from Comet on the 18th November 2007. It was £249.99 instore, £199.99 on there web site. Managed to get it at that price.

Took item home, struggled to get it in the car, but we did (its a clio), and dryer worked fine.

Dryer is a Hotpoint Condensor Dryer.

Thursday night, laying in bed. Electrical Sockets trip off, go downstairs, Dishwasher, Dryer are both On. Washer is Off.

Select trip switch back on, trips after 20-30secs. Unplug dryer and dishwaher, and put it back on. Put dishwasher back on. All ok, Put dryer back on. Trips electic. Unplug dryer, put electric back on. Go to bed.

Next morning (friday), plug dryer back in, trips electric again.

Went to comet in the morning, took receipt. Spoke to 'Customer Services' and asked them what we could do, as we bought this dryer from them, as they were a big company. Told them we had a 12 day old baby, needed dryer to dry the clothes.

Told that engineer would have to come and look at dryer before anything can be done with it. Told engineer could come out on tuesday too look at it, and tell us what to do with it.

At that point i reminded him the dryer was 19 days old. And should not be doing this.

We went home, I removed all draws from the dryer, and water poured out the bottom onto the kitchen floor. Used a towel to scoop it all out, and left it open for about 20mins, when i plugged it back in, and the system works now.

Where do i stand on this.? Ive googled the dryer, and it comes back with a history of tripping the electrical power.?

Dryer today is 21days old.. :(

This sounds dangerous and you certainly shouldn't use the machine again.
Contact Comet and tell them that the machine has an inherent fault and show them the information you have gathered from the internet. Tell them you want an immediate replacement without any further delay. It is unlikely you will want one of the same make so make this clear to them. If you bought both appliances as a matching pair tell them you want both replaced.

If there is any problem from Comet tell them you will go to the Small Claims Court where you will also sue for expenses. There is no doubt you will win in any court action.

im sorry if this is posted in the wrong thread, please move if necessary I couldnt think of where to post this and if it is relevant in this site.

Please advice on what i could do and of my rights.

My mother had visited her local woolworth store today at around 3.00pm to return an item for a refund. She was refused to have the item refunded, as the employee believed it had a mark or dust and offered an exchange. My mother said that the mark was already there when she brought it and as she did not have no intentions on returning it as it was for her younger daughter, didn’t bother mentioning it at the time of purchase. Because my younger sister did not like the item, my mum decided to return it. My mother mentioned that there are other clothing in sore which have marks/dust as sometimes they fall on the floor abut again she was told she cannot have a refund. She got angry and got hold of her younger child and moved away.

Next minute she was told to leave the store by a young male employee. He became aggressive and pointed her to leave while leading her towards the doors. My mother was shocked and asked why she is being asked to leave, instead the employee who also got the manager involved told my mum to leave the store in a very rudely manner. My mum got humiliated and embarrassed and felt insulted and left in tears.

She rang me and explained what happened and I got there immediately. I went in store and ask to see the manager. I was told that the store manager was not in and I could see the supervisor. Even though my mum was socked and in tears I told her to come in store with me so I can have this discussed with the manager. When she came in, the same employee came towards her and told her to leave. I asked him why he was telling her to leave and told him my reasons for being here to find out why exactly shes being asked to leave with no explanation. The employee refused to talk to me, in the meantime the manager came and said that my mothered had sworn to the employees at the tills and was asked to leave again. My mother was standing their traumatised and crying and said that she did not swear. I asked the manger that if it was possible if I could talk to the employee who said to be sworn at but instead I was told to leave the sore. I said that I am here trying to find out the reason why mum was told to leave the store and without talking to me in an appropriate manner im being asked to leave instead. My mother cannot speak English, when she came in for a refund she had her 10-year-old daughter translating for her, as the employees did not speak her language. What I don’t understand is that how can an employee tell my mother was swearing if she had when they cannot speak her language. The manager would not reply to my question but told me to leave, I said that I have a right to know and the right to put this straight, the manager told me that she is calling the police and security if I don’t leave. Not only my mum was told to leave in a rudely manner but so was I.

I did then get the managers attention as I said this is not professional, all im asking is for an explanation, if my mum did swear it was the right of the manager to tell her to leave but in a rightly manner. The manager told me that she was keeping an eye on my mother from the shop window and how my mother was sat on the bench and making phone calls. Why was she keeping an eye on my mum? She also said that she could refuse the entrance of anybody if she wishes to without no reason. I said that that is not right, she cannot do that unless there is a reason.

The employee caused a scene and got the attention of all the customers while telling my mum to leave. The same had happened to me and I asked for the manager for her name, the details of the employee who said she was sworn at and the employee who told my mum to leave, but she said she does not want to discuss it and in the meantime the security came in. I decided that I would leave as I did not want to upset the other customers

I believe that my mother did not swear as my mum doesn’t swear. And if I wanted to find out what happened. My mum felt like she had committed an offence or she was a criminal. I habe never seen a person speaking so rudly and above all it was a manager, the employee and the manager was having a laugh within themselves when they had called the security and was giving me sarcastic looks. I have never felt so insulted in my whole life.

Firstly, the store does have a right to ask anyone to leave without giving a reason or to ban anyone.

It's difficult to know the best course of action. You could write to the head office and lodge a complaint about your Mother's treatment or you could simply put it down to experience and decide not to shop at this particular store again.

Engineer has been out today, removed the rear cover over the heater and informed us that there was a water mark on the inside of the cover. Said that water sits in the bottom, and when the fan starts up it sprays it onto the heater, and trips the electric out.

Said as i dried it out the other day, all is ok and he checked all the filters.

Said he can change the element, but it wont make any difference as its working. So therefore its all ok. He tested the earth / neutral line i think, and all is ok.

Going to contact comet this morning, too see what goes on with the dryer now. Unsure if to replace, or just deal with the thing.

Phoned them this morning and they are unwilling to give me a full refund.

I've said I want it resolved today as they are now trying to claim the original tv I had didn't have a fault, (I have photos of it doing the fault described) and they swapped it as a show of good faith.

I've stated I do not wish to have either of the televisions if they have intermittent faults. They are now going to call me back again after 2:30pm but I'm not holding out for an answer I like.

As this thread is over 1000 replies long, I'm sorry to be a pain, but is there any sort of templates on the procedures I should take.

I will be telling them I will be writing a letter, but again as there attitute kind of stinks on the refund front I will no doubt have to go the whole small claims route. Again I just wonder are there any letter templates around or steps to follow. The HMcourts website I;ve been on is pretty confusing.

    Any help much appreciated.
  • Hi,

    Just a quick question!

I was tasked by my parents to purchase a PC for my brother for xmas as hes just strated secondary school.

I did a lot of searching around to find a good deal and managed to locate one on the PC World website. It was a clearence model heavily reduced in price. It was showing unavailble to collect in store, but was available for delivery.

I ordered the PC straight away and got the usual emails saying: The last one being on the 5th December.
This is to confirm that we are starting to process your order. When we are
able to confirm your order we will send you a third email, which will also
    confirm dispatch of the goods.

Received a phone call from PC World apologising that they did not have the item in stock and would not be getting anymore in. Would I like a refund.

I checked my bank account and they had actually taken the money. Im just furious that its taken 6 days (ordered on the 4th) to advise that they dont have the item in stock.

I did check their website again on the 4th - about 6 hours later and the PC was still showing however as out of stock.

Have I got any grounds for a complaint?

If you look back on this thread i think you will find PC World is the subject of many complaints. If I were you I would get a refund and go elsewhere. Dell seem to have a good reputation and may be worth a look.

I don't think you have grounds for a complaint. I suggest you remember your experience the next time you want to buy anything electronic.

At this point I would simply write, recorded delivery, rejecting the goods and informing them that you will instigate proceedings in the Small Claims Court if the matter isn't resolved within 7 days. See what response you get and let us know.

In case you need to go to court have a look at this URL for information:
