    Mmm wish some of my payments would take three months! Short answer no you should have realised the money hadn't been taken, especially if as you say it was for a considerable amount!

    Not sure of your problem:confused: Had you paid by cheque then it could legally have taken 6 months for them to present it.

    It is strange that it took so long but hey! you were expecting it - or have you that much in your account that you failed to spot it - OR, have you spent it and were hoping they had forgotten??

    Afraid I cannot see that you have any legal recourse

    Bought an Indesit Washine Machine nearly 2 years ago from B&Q.

    We have had a few problems but these were sorted out within their 1 year guarantee.

    The drum has gone again this week and I have sent off an e-mail to B&Q expecting the normal 'not in guarantee and without extended warranty'.

    Although I am due to send a recorded letter to the MD of B&Q outlining my rights under the sales of goods act, time is of the essence.

    As a family it is extremely important to get the machine back in working order.

    Is it reasonable to get the thing fixed and claim the money back from B&Q ?

    What do you reckon guys.

    Is it just a case of having to wait for a response from Head Office.

    Is it reasonable for machine to fail again after 2 years when it cost in excess of £250 ??

    Look forward to hearing from you.

    It isn't reasonable for the machine to pack up after this length of time.

    Unfortunately you are not able to get the machine repaired without B&Q giving their permission. When you write to them outline your problem and tell them you expect them to deal with the problem in a reasonable length of time. I assume they don't handle repairs themselves but use contractors so there is no reason for any delay.

    No, you have no recourse. There is no obligation for a retailer to proccess your payment immediately. You had the use of your money for a longer period than you had expected.

However, before I phone the shop, what is my best approach, and am I right in reversing the £321.75 transaction. as in theory I did agree at the time, to purchase the tv for £325?


    The store has acted quite legally in rectifying the problem. You do not have any claim against them.

    Thanks. Yes, I'm still in the US until next week and been a little out of touch for the past 4 weeks or so.

    I haven't been getting all the emails telling me there is a reply to read - maybe gremlins in cyberspace.

  • Bought 3 mobile phones from a shop where the salesman assured me that internet useage was included in the tariff. Turns out it's not, and I'm being charged each time I access the 'net.

    The shop are refusing to take the phones back as 14 days have passed since purchase, but how was I to know within 14 days as I hadn't received a bill by then?

    Advice please!

    Write to the company, recorded delivery, giving them 7 days to refund your money. Tell them if this isn't done you will go to the Small Claims Court. If the company you purchased the phones from is a national company write to their head office.
