    I do not see that the OP has a leg to stand on! Everyone knows a salesman will tell you anything to get a sale - especially if three phones involved.

    OP should have checked the contracts before signing and at any rate before he got his first bill!

    No jet lag as I am still in the US but thank you for your concern.

    FYI verbal statements can form part of a contract although difficult to prove. A letter to the head of the company could result in a satisfactory outcome on customer relations grounds.

    Also if this went to court a judge would weigh up the possibility of the statement having been made. If he decides it was made he would find for the
    plaintiff.

    The shop said exactly as Tracy predicted they would, but fortunately the nice man at customer services took pity and a fat cheque is (allegedly!) on the way to cover the extra cost involved

  • Please can anyone help

    My partner brought me a white gold ring as were getting married.
    He brought it within a year ago but it has snaped.
    He cant find the receipt but thinks he paid on his card. I took it to the shop
    they said they wont to ankything without proof of purchase. He phoned the bank and he wasnt quite sure if he brought it December of January the bank want 10 pounds per bank statement.
    Has anyone got any ideas what rights we have without a receipt

    Can anyone help me with my rights on this one?

    I bought a laptop dec 06 and it has recently broken and gone on for repair to have the hardrive and motherboard replaced...expecting it back today.

    When it went in i specifically requested during the call and was told a note had been put on the system for them to return my hardrive for data recovery.

    I've since found out that i had to pay over £100+ for me to get it back and wasnt advised this at the time.. also i'm waiting for the manager to ring me back as i've been told the drive may have been returned to the manufacturer therefore it it LOST! with all my data on it. :(

    I don't want to let this go for various reasons including the laptop was under 1yr old but has fair enough been repaired, if the hardrive is there i have to pay for it to come back to me at over £100 and then i have to pay for professional data recovery (as i hadnt back it up my error) but as it was so broken the basic recover instore didnt work... also if they have lost it then that is their error.

    The retailer is within his rights to ask for proof of purchase. This can be in any form that makes it clear you bought the ring at this store. If you have online banking you will be able to check your statements free of charge, otherwise you are going to have to decide if it's worth paying for pasper statements. Check how much the ring is going to be to have it repaired and then balance this with the cost of obtaining proof from your bank.

    The retailer may even be good enough to check his records if you tell him roughly when the purchase was made.

    The bridal shop where I purchased my daughters wedding dress from closed suddenly , less than 2 weeks before the wedding. No notification, nothing. We discovered that the shop was part of a franchise and were directed to next nearest store, who we had been told were dealing with everything and that our dress and all accessories were there - unsurprisingly they could find no trace of it.

    With less than a week to go we had to go out and purchase everything again - not an easy task at such short notice.

    As I had paid for more than half the cost of the oricinat dress, etc using my credit care I asked them to pursue a refund. After many phonecalls, letters and chasing about - it now transpires that the original gown (but no accessories) are with a dressmaker.

    I have now written to the credit card company confirming , with proof that the shop closed before the date of the wedding , and that the dress has now been found with a dressmaker.

    Where do I stand with the credit card comapny re a refund, the dress is of no use to us now as the wedding took place more than 2 months ago?

    Any advice/thought would be grately appreciated.

    You should be entitled to a refund of the full purchase price you paid for the dress as you paid for it in part with your credit card.

    Don't let them argue that the dress was available to you as it wasn't on the day you wanted it. In a situation like this 'time is of the essence'. A wedding dress is of little use a day after the wedding. Point this out to them.

  • I'm a fairly regular movie-goer and have noticed how, over the past year, the price of a cinema tickets has gone up from £5.40 to £6.70.

    Recently I've seen a few absolutely awful movies, most of them the over-hyped blockbusters (Spiderman 3 and Superman being two prime examples). As a consumer am I entitled to money-back if the movie completely disappoints or if I leave the cinema early because the product is truly awful?

    I have a friend who once bought a CD and then got a full refund beacause in her opinion the music was rubbish. Can you do the same with cinema?
