Property purchases are not covered by the Sale of Goods Act.
However, you probably have rights under the NHBC guarantee or other guarantees which Persimmons may have given.0 -

But the NHBC guarantee isn't worth the paper that its written on, to be frank.
I just wondered if there was a way that I could shame them into repairing it as it would seem unreasonable that the window will now not open.

Only once had cause to call upon the NHBC and was pleasantly surprised. Just their involvement made the builder spring into action.0 -
Hi all... yet again I return to this thread in need of advice. Is this a record ?
Anyway, I bought a 'clearance' pay as you go Nokia handset from e2save.com (yes I know they're a part of CPW) for a tad over £50 about 2-3 months ago. More and more I notice on ocassions during calls people could only hear muffled sounds, but i could hear them correctly. This was usually corrected by redialling either by the other person or by myself. DIdnt think much of it until it kept happening more frequently so I took the phone down to carphone warehouse for a warranty repair.
They sent it down to their nokia repairs center, and to my surprise, two weeks later (i.e. today) i picked it up with a report saying the phone has 'liquid damage' and is beyong repair. This is very surprising because I don't ever recall dunking it in any water myself. The phone has always worked fine i.e. no dead pixels etc... its just the odd muffled voice which the other caller hears on their side...
So... because of all this, is there anything I can go back to e2save with? How can I prove to them I was sold a phone with liquid damage ???

My son bought a second hand car from garage around 6 days after buying it is started cutting out sometimes... He carried on driving it thinking it would be ok but then it started getting worse and now it does it a lot. He rang garage up 2 weeks after buying the car and the dealer refused to do any-thing about it. my son saved up and worked hard to pay for a car that now doesn't work properly and I wondered if we could do something about this?
I feel so sorry for him he paid £2500.00 and now he needs another £240.00 to put it right....
Please help!!!I have 2 PPI claims all being dealt with by FOS could do with a win. I also have 1 PPI claim with FSCS because company gone bankrupt.
I have claim for bank charges on-hold for 3year

Sounds like he may have a case of the car not being of merchantable quality and maybe a case of the car being sold in an unroadworthy condition which is a criminal offence.
I would speak to the garage and inform them that if they don't put the car in a roadworthy condition you will take them to court. It would be very useful to obtain an independent report from someone like the AA or RAC. This will cost money but could prove very useful and may even unearth other faults.

just been on the phone to E2save and they've fobbed me off with 'theres nothing we can do'. Is this right? Have I not got any rights in this case?0 -
Hi Not sure if you can help. I wrote my car off in an accident, have to travel 30 miles to work so was desperate for a new car. The chap up the road has a car lott, we bought a 10 year old car from him on a Saturday morning in November - he said as he was due to close it needed to be cash - I know how stupid, anyway I got the cash £12,000 bought the car, got a receipt, it had not long passed its MOT. After a month a so I though it sounded a bit odd and felt something was wrong with, it. I was assured it was just me - anyway car completed died in the February, garage said it had no end of problems which would cost more than the car, it wouldn't even move. Car had to be scrapped. Was informed I couldn't do anything as car was bough as seen!! Do I have any rights?0

You bought a 10 year old car for how much??!!
If the garage you took it to is prepared to do a statement confirming that the car was not fit, at the time of purchase you may have a claim against the seller, but you have scrapped it? so that might make it tricky, the statement "car was bought as seen" carries no legal get out, it is actually an illegal statement and does not take away your statutory rights as a consumer.
Why if the car was scrapped in February are you asking fro help now 5 months later? You have not done yourself any favours.
For future reference if someone asks for cash only, try and get them to accept at least a deposit,(£1. will do), on a credit card, you then have the back up of Section 75.
You will need some evidence to pursue this with Trading Standards as it is a criminal offence for a trader to sell an unroadworthy carDon`t steal - the Government doesn`t like the competition0
