    Ignore that, it is a European directive re a 2 year warranty, our Sales of Goods Act, (SoGA), is better as it allows you up to 6 years to make a claim against the retailer, (not the manufacturer), see BERR, Which. and Consumer Direct. Also SALE OF GOODS ACT 1979.


    You need to go back to the retailer and request them to put the problem right, they will fob you off, print some of the info on those links and take it with you.


    If you paid by credit card and the Tomtom was over £100. you can also claim against the card company under Section 75 of the Consumer Credit Act, see WHICH.

  • I wonder if someone can give me some advice regarding my car and local garage where I take it.

    Since Dec '08 I've spent quite a lot on the car due to one thing or another:
    - £300 odd for O2 sensors due to engine management light coming up, but this turned out to be the catalytic converter that had been fitted by another garage!
    - £150 odd for new radiator due to water leaking, which didn't solve the problem
    - £260 odd for new water pump and cam belt

    The latter fix sorted the water problen, but the cam belt went whilst I was on a busy motorway 3 days after I collected the car from the garage.

    They grudgingly came to collect it and have since had the car for just under 2 weeks.

    I was given a "courtesy car" last Friday, which leaves a lot to be desired, but it works even with the overbearing advertising all over it, flat front tyre, dog hair on the seats, cobwebs and dust... The list could go on!

    Anyway, my questions are:
    - should they be giving me a specific date by which my car should be ready? (they don't return my calls and when I finally got the owner on his mobile yesterday, he muttered a lot of expletives and something about the work being done was worth more than the car)
    - can I expect them to reimburse me the money for the tow truck I had to get out to collect me on the motorway (£135 out of pocket due to their error)
    - am I covered by any consumer rights or trading standards laws?

    By the way, my car is 5 1/2 years old (MG ZR) and I had it from new.

    Firstly, the cam belt should be changed regularly as per the manufacturer's service brochure. They can go at any time and you cannot hold the garage responsible unless they have failed to ask you if it should be done.

    They should provide you with a date by which the repair will be complete. I would initially call in person and ask them to do this.

    You don't say who is paying for the repairs, you or the garage.

    Thanks for your response Art.

    I've been paying for all repairs.

    I understand the cam belt should be changed regularly, which is what they said they did along with the water pump as it comes as a kit, but should it only last for 3 days during which time I drove it once? As far as I've been told by the tow truck mechanic (and even my Mom), plus the garage confirmed it - cam belts should last for around 60,000 miles. I believe this one did maybe 50 if that before it "went". The garage stated the belt was not faulty, therefore the fault must lie with their fitting, which is no doubt why they are fixing the car albeit grudgingly and very slowly as the cam belt going has caused numerous other problems (all 16 valves need replacing and the head gasket has had to be removed, etc.). What started out as a relatively small job is now an engine rebuild!

    The garage should be covering the costs of the current repairs.

    I suggest if the garage is paying you let them get on with the job for the time being but speak to them to see if they can give you a date for completion. If you upset them at the moment you will only upset them and they could delay the repairs further.

    I bought an Ipod classic from Amazon 11 months ago and now the battery is dieing.
    It was a present from my Mum so I asked her to look after the receipt (which she is trying to find) but I actually ordered it myself. So I can see it on my previous orders on amazon. But there does not seem to be an option to return goods to amazon after 30 days.

    Apple say it is no longer under warranty, presumably because they do not know when it was sold and may have sat with amazon for a while before sale.

    Anyone got any advice on trying to get it fixed/a replacement?

    This is Amazon's problem and not Apple's. Contact Amazon and tell them to sort it for you. They may involve apple but that is their right.

    Amazon will need proof of purchase but this can be in any form and if you are seeing it on your Amazon account that is OK.
