Thanks Art- I did try this and in total have had 5 emails go out to them and several phone calls. Each time I was refused. I guess they must have changed their minds as I have now just today had an email to say they will refund me the £143.90 that was charged. I am ok to let the £14.99 go as I can see me spending a further £15 in phone calls to them trying to get this back! but thankyou for your reply, it seems persistence pays off! (persistence being at least one phone call and one email per day every day!)0

Am not sure if this is the correct place to put this..but here goes!
I bought a flat screen from Dabs at the end of Aug 2007 and was working fine until the picture went (coloured lines across it, images were shades) basically it was unwatchable. I went to a local PC shop and the guy told me that it would cost more to fix than to buy another one.
Now I know this is out of the year guarantee but I wanted to be fore-armed before I contacted Dabs as this will be their defence to get me off the phone. Shouldnt the TV have been able to work for longer that a year and four months. Is this under the sale of goods act (I studied this as part of home economics when I was at school, many, many moons ago- so not really upto date with it lol) and when it breaks, there is something to do with it being merchantable quality? I was wondering could some one offer me advice on the things I should mention to DABs....will be pleasant to them, but dont want the wool pulled over my eyes!!

Send a recorded delivery letter to the owner telling him that if you don't get a refund within 7 days you will contact the Police and report him for fraud. You could also consider taking him to the Small Claims Court for non supply of goods. Don't hang around on this as I wonder if he has the money to pay you.
If you paid with a credit card send a copy of the letter to the card company.

I
Contact Dabs and tell them you don't expect this item to fail in such a short time. Tell them that you expect a repair/replacement.
After this length of time Dabs may ask for an engineer's report if you are suggesting the TV has an inherent fault.
If you paid by credit card notify your card company as well.

Can I ask, you mentioned the credit card company- you say to notify them, bit confused as to what you mean- to notify them that I am looking into this?

Notify them to inform that you will be holding them "equally and severally" liable under the Consumer Credit Act Section 75.
They are as liable as the retailer as the supplier of credit and can be sued with or without the retailer under that act.Don`t steal - the Government doesn`t like the competition0 -

Friday i went into a SHOP and brought a bed and base, they delivered next day - monday. When I tried to essemble the base I found the follwing
1) I could only get 3 (of the 8) casters in half way
2) 1 couldnt get the other 5 castors in
3) the holes for the head board only went through 1 piece of wood so I couldnt attach the headboard
4) they had only sent 1 joining clip so i am unable to put the two parts of the bed together.
5)one of the metal bits that the castor goes into has comes out.
All in all quiet a shoddy base. I contacted them yesterday to tell them of my problems and that i wanted to return it - as it wasnt fit for the purpose - unfortuantely i had to leave a message on their answer phone. when they hadnt got back to me by this afternoon i rang the customer services number - spoke to a person - told them my problem and they refused to let me return it. instead they are sending someone out to check the bed over.

You are right. Send them a recorded delivery letter telling them you reject the bed as 'not fit for purpose and not of merchantable quality'. Tell them if they do not refund your money within 7 days you will go to the Small Claims Court. If you paid my credit card copy them is as they are equally responsible.
Do yo think the bed has been used? It sounds like it. Take some pictures in case you need them.

Hi. I have just taken delivery of a brand new Playstation 3. However, I didnt order it and I havent paid for it! To good to be true??
I enter a lot of competitions so it could be a prize but I have not been informed by any promoter. The delivery note is from Misco and has the address of the person who made the order, (which I dont recognise) and mine as the delivery address.
Could this be an error by Misco whereby their computer has attached the wrong delivery address to an order?
I have not opened the box incase someone claims it as a delivery error but Im wondering, if someone does claim it back, is there a time frame for a claim or can I refuse to give it back?

Write to Misco telling them what has happened and ask them if they can explain what's happen. If they want the unit back tell them to provide packaging and also pay you in advance for the postage. If the matter drags on tell them that if it isn't resolved by (date) you will assume they have agreed that you can keep the item. Keep a copy of all correspondence.
