Hi,
I bought a fridgefreezer from comet 2 years ago along with their £2.99 monthy cover plan.
We had a repair on it about 14 months later as the temparature in the freezer was getting warmer.
When the engineer came out, he said the fan had frozen over. Due to a design fault, excess water during defrost mode doesn't drain properly. It freezes in the area it collects and the process repeats until it reaches the fan.
He defrosted the freezer and raised the front legs to help drainage.
Anyway, it's done it again.
I feel that it not fit for it's purpose and we should be entitled to a replacement. Currys said we can only have a repair, but surely if we bought a frost free freezer, it shouldn't have ice build up anywhere. Just because we can't see it, doesn't make it frost free. Also, it will only happen again.
Do you think we have a case to argue a replacement? It's out of the 12 month manufacturer's warranty, but we pay for extended cover.

Sounds like you have a good case for a replacement. Write to them stating it is not fit for purpose. If you paid with a credit card inform your card company they are also liable.

My wife and two young children took some goods to the counter at IKEA. They passed through the cashier (who unlike other stores sits between you and the goods), we paid for them but we did not see them at the end of the counter for us to collect. We have written twice and received one written reply and one call rejecting our claim that goods remain the responsibility of the retailer until such time they are received by the consumer but to no avail. Their cameras do not cover the area past the till (i.e. they can not see what happens on the counter past the till), so we do not know what has happened to these plants other that presume stolen. Have you any advice?0

I bought a laptop on the 28th November 2008 from Currys, it's just started turning itself off, I'm reinstalling Vista as we speak and hoping that when I take it back tomorrow I can get a replacement or a credit note so that I can get another laptop. Is this the case?

Initially I think they are more likely to offer a repair. If they insist on this write to them telling them that you will accept it but will demand a replacement in the event of a further problem of the same nature.

Would be grateful if anyone can advise on this one -
At bracknell discovery centre this afternoon took a small but clearly priced item to the counter - was told the price had "changed" - no signs anywhere - and that the item was £1.70 not £1.50 now. OK small amount - I said I didn't think that was right - the lady said her manager had said that the price was an "offer" to the consumer and they could charge what they liked?!!!
This is wrong surely?
OK it was a small amount but she said I was lucky as other items had gone up "significantly more". I did argue a bit but had a 2 year old wanting her nemo - I would like to follow it up though and point out that they were wrong (if they are) for other consumers as she said ALL the stock wasn't been repriced til Saturday! It is Tuesday today...

They were right and you were wrong. A price shown on an item is simply an offer to trade.
It only becomes firm when the item is paid for.

Sorry if this is in the wrong place.
I was wondering if anyone could help me.
On 11th of January I ordered a cake tin from a company called 'de Cuisine'. They took the money from my account the following day.
The webpage stated the tin would be dispatched within 24hrs and posted first class.
The site has email, address and phone number with an order status.
Since the order was placed, the status has been 'your order is being picked at our warehouse.'
I have emailed twice (no reply) and the phone number is just an answer machine stating lines are busy.
What do I do next? Do I give more time (despite the 24hr promise) or take further action?

If you're happy the company is still in business I'd say stay with it although you have the right to cancel. If you do cancel you will have to start again with anther company. Give it a few days before you cancel and the item may turn up.

Any ideas how i could attempt to get my money back if it doesn't arrive?
Would I need to write to them as they don't seem to be answering the phone or emails?0
