    Zavvi were extremely helpful and had no real desire to try not to honour their obligation as set out above.

  • i purchased a jacket from usc in glasgow paid cash but have lost the receipt and need to swap for a large the shop has refused do i have any rights thanks stuart.

    Only the shops goodwill, unless the jacket was supplied in the wrong size after you asking for a certain size.

    Although as it was a jacket from a shop, you would have had the opportunity to try it before buying.

    Hi,
    I purchased a Laptop from eBuyer in July 08. In September I returned it because it had developed a Power-on fault.

    It was repaired and returned swiftly, however the fault has returned again in late December.

    I'm trying to contact them to return it (difficult as they don't answer the phone...) Ideally I'd like to request a replacement as the fault has not been fixed satisfactorily and I am concerned that the machine was basically not fit for purpose as the fault developed relatively quickly from new.

    I'm sure that they are a fairly 'hard-nosed' company so am looking for tips and hints to get a replacement rather that repair?

    Write to them, recorded delivery, telling them the laptop has an inherent fault and under the Sale of Goods Act you want a replacement. Tell them if they don't resolve the matter within 14 days you will go to the Small Claims Court.

  • I bought a brand new, just released, Sony Ericson C905 contract phone on O2 with the very useless Carphone Warehouse on November 8th, but this wknd it developed a fault (so it's not even 2 months old). When I am in a call I can't hear the other the person unless I turn on loud speaker which obviously when I am out in public isn't good. But because the phone is free I am not sure what my options are, the woman in the shop said because I didn't take out their stupid insurance all she was gonna do is send it to the manufacturer, I know the shop is the one who's meant to look after me but am I entitled to a brand new phone or do I have to wait 8 weeks for it to repaired? I know they usually give you a free temporary phone but I was never even offered one I actually BOUGHT a cheap phone to use instead!

    yes you are entitled to a replacement phone but from past evidence the phone shops are extremely difficult to deal with. They do not seem to know/care about customer rights.

    A strongly worded letter initially to the CEO, Charles Dunstone may get you a result.

  • hi all and happy new year,this is my first time here and not sure where to put this any way this is my question if anyone can advise,my wife was a member of choice shopping catalogue which she resigned from in october 08 we did understand that 3 more payments were due ammounting to appox £120 and we have carried on paying now we have had 2 letters saying we are behind with payments we have got copies of cheques from bank saying the 2cheques were cashed by choices and dates etc we have sent copies to choices but no replies and we are getting more bills for arears and they are adding default charges of £12 per time,if this carries on with no comms from them can i take to small claims court to stop this going on,regards roger

    Send a recorded delivery letter to them, and also the company sending you the default letters if this is different. Lay out your full facts and demand that they reply confirming your account is clear and they stop sending incorrect letters to you. This normally does the trick.

  • hello all,

    my wife recently purchased a skirt for my little girl to use over xmas from tesco, which was reduced from £6.99 to £4.99. The first time she put the skirt on the seem all fell apart, my wife return the item back to to store and was told as she did not have the receipt they could only give her the sale price for the item which was now 0.65p, I do not believe they have this item in stock any long so they cannot replace it. how do i stand in getting the full price paid for this item refunded?

    She did pay for this item on a bank card but she purchased other items at the same time also.
