  • What's my rights in regards to this situation?

    I bought a Babyliss Hair Straightener from Littlewoods Direct for £28.38, before I realised how bad of a company they really are. They dispatched the wrong goods, and I received a Elonex ONEt Plus worth £149.00.

    They did not realise the mistake until I pointed it out, but are being really unhelpful about getting me the hair straighteners sent out before Christmas without having to pay again, so legally can I keep the item they have sent out in mistake?

    I ordered £35 of stuff on Nov 15, 2008. I had a confirmation email.
    I waited for it to be delivered, or to hear from them, and At the end of November I emailed them asking what is going on?

    They said that the parcels had been sent back to the main office as they could not find my house, I emailed them back with directions as asked.

    Again I heard nothing from them. A couple of days ago i contacted them and they are now claiming to know nothing about the order that I placed. I have forwarded them all of the emails as proof and have heard nothing from them - I then sat on the phone (on an 0845 no.) for over an hour being put on hold and told me that I'm the next customer waiting. I then found a number that isn't 0845 for them, and I was cut off.

    Is this a scam? Has anyone else had this problem? Sorry if this is in the wrong place, I ordered this over a month ago for christmas and it just seems like they have got away with £35 of my money! (that has already been taken from the account). Thank you,

    try and get your money back quickly..it says the website is closing down on the site:confused: . I would send a copy of the confirmation email to them asap demanding your money, followed by a firm telephone call,...you might want to call trading standards for advice, before they cant be contacted any more.

  • Thanks for that "useful" post Sid. I also had problems with this company and waited 5 weeks for delivery. My order only arrived after I had told them to cancel and refund. My friend also waited weeks for the delivery of her items. I think the excuse of not being able to find your house is exactly that!

    The warranty does not come into it in this case. You were sold a refurbished item that was meant to be new. AND they made effort to cover it up - though I'm not entirely sure it was Argos that did it if the R was under the serial number (would have been done before it was packaged). You clearly know from your post that this is very wrong. First I would contact Argos customer service, (they might tell you to contact Creative), (sorry - don't know how helpful they are!) and complain about this, secondly I would then contact Trading Standards (unless you get a really good response from Argos - then it is up to you whether to proceed or not).

    Be very certain of your facts though - are you sure this means it is refurbished or is it just a comment a mate made? How did you find out it meant refurbished? It has obviously given reasonable service for a while but that is probably irrelevant to you right now, you sound slightly annoyed at this!

  • With the many High Street collapses in recent weeks/months, I got into discussion with a mate who said that someone who bought and paid £7000 for a kitchen. Half cash and half on his credit card that the credit card would be obliged to cover the full cost and not just the credit card part payment if the company went out of business and couldnt deliver the goods.

    Could soemone please confirm the credit cards obligation on the above scenario.

    Yes, this is right. So long as a credit card was used for part of the payment then you are covered for your full transaction.

    Once again I turn to this excellent thread for advice. Bought an electrical part for my car a couple of weeks ago. The package has since been opened, but in the end it turned out that this part did not need replacing and a fault was diagnosed and fixed elsewhere.

    I called up the dealers who say that as its an electrical part and opened, they cannot accept it for a refund. Is this right and do I have any case for them to provide a refund at all?

    You are not entitled to a refund im affrad, however try taking it back and dont say its been opened they may charge a restocking fee which is better than nothing, its usually 10-15%

    Sorry if I've posted this in the wrong place, I couldn't find anywhere else to post it.

    I received some Debenhams gift vouchers for Christmas and went to my local store yesterday to spend them. I had £50 of vouchers but only wanted to spend £42. They said they wouldn't give me the £8 change in vouchers so I had to spend the lot! I ended up buying something else that I didn't particularly need to make it up to the full £50.

    I always thought stores gave change from vouchers in more vouchers. Are they allowed to refuse to do this?
