I'm pretty sure that you can only claim damages if you can show that some damage has occured as a result of your data getting into the wrong hands.

Bit of advise needed this afternoon..... Hope you can help :-)
Purchased a Plasma TV from Littlewoods direct and had it delivered on Friday. That evening when the TV was turned off i noticed a wedge shaped darkened area on the screen. It looks like its on the glass, but you can only tell when you have dark screens or the TV is off.
Anyway ive spoken to Littlewoods direct who have said to return it and they'll send another out. I've told them i would like a replacement sent and i'll send this one back. They have now said i need to have an engineer called out to check it who may send it away to get repaired and then brought back to me. I'm not happy with the fact i had a Tv less than 24hrs and it needs to be sent away to be repaired. Engineer should be out this afternoon but what if they say it can be repaired ???? Where do i stand ? Can i demand a replacement sent ? Surely a TV less than 24 hrs old should not be sent away to be repaired ?
Any advise would be appreciated0 -

For the length of time you have had it, you will be entitled to a refund or replacement, tell them you are rejecting it under the Sale of Goods Act,(SoGA), as "not of merchantable quality".
If they persist you can always send it back under Distance Selling Regulations, (DSR), as damaged goods, for this they,not you, will have to pay the postage costs for return.
Under DSR you have the right to return goods within working 7 days following the day you receive them without reason, you may have to pay P&P, but not if they are damaged.Don`t steal - the Government doesn`t like the competition0 -
I purchased a Netgear Modem from maplin in May this year, in October it wouldn't allow me to connect to the internet and I had to call up Netgear's technical team who after over an hour on the phone got it working again, then last week the same thing happened again. After another hour on the phone the technical support got it working again but said it was obviously an ongoing fault and it would need to be replaced. He offered me 3 options for replacing the modem it could be delivered in 6/7 days for free, 3-5 for £15 and 1-2 days woudl cost more, i said i didn't want to pay anything as it's not my fault it was faulty and as the internet was actually working i would go with the 6/7 days option. He then gave me contact details for the delivery company and told me to call them and quote a reference number and they will arrange a delivery date with me, on the day I should place the old modem in an envelope with my reference on it and they will collect it when they deliver. Today i called the delivery company and they said they will collect my modem and deliver a new one three days later, i explained that i had been told they would deliver and collect on the same day and she said no this cost £15 extra. I called Netgear but they have a callback service so i am waiting for them to call back. Could anyone advise me on my rights or recommend what i should do about this I can not be without the internet fro 3 days i need it for work0

Thanks for the response. I know i can send it back but i was curious to know if i can demand a return and replace on the same day. Surely they could send another one and i swap it over then or i'll be without a tv and a metal bracket on the wall till after xmas.

They have taken the funds (£29.99) from my credit card.
Am I right in saying that they are obligated to sell me the item at the price I paid as they have entered into a contract, or are they within their rights to make me wait till well after Xmas (For which the item was purchased)
FWIW we purchased through PIXMANIA which directed us to the above company.
don't know if that makes a difference.

I have been a lurker for sometime but felt i had to join when I found this email from ibitsore.com above.
On Saturday I too ordered from them and received exactly the same email as above tonight at 1820 hours.
I have emailed them back questioning as to why the item would be unsuitable to send, also why they show on their website they now have 148 in stock and funnily enough they have upped the price by £14.
Just wish they were honest and confessed they made an error on pricing, does not take a genius to work it out!
There is nothing we can do about it as Art stated, most internet shopping sites do state in their terms and conditions that there is no contract until the goods are posted out.

I'm sure I'm just going to be told that the following is my fault, but I wanted to see if anyone had suffered a similar experience.
I was shopping at Debenhams for perfume, and had been going in each day to try fragrances for a family member. I finally decided on one, bought it, and took it home. (At this point, I should point out that I thought at the time I had received a very good deal, as it was a bit cheaper than I had expected.)
When I arrived home and removed the box out of the bag, I immediately noticed that it contained 200ml. Knowing that this was not possible for perfume, I scanned the package to discover that it was shower gel. In exactly the same packaging as the perfume, exactly the same design size and shape. I had taken the box from the shelf right next to the perfume tester bottles.
When I returned the product, I asked if they had this happen a lot, to which he replied 'yes'. Instead of a cash refund, I was told I could only have store credit on a gift card. Hmph.0 -
