    The guy from sony centre is coming to have a look at it later today,but i just wanted to know my rights just in case he says i cant do nothing about it

    You are entitled to demand a refund or replacement if there is a fault with the TV.
    Under the Sale of Goods Act you can reject the goods as not being fit for purpose and not being of merchantable quality.

    Heres a good one...

    Bought a camera from https://www.kodak.co.uk arrived yesterday but is faulty.

    I didnt like the camera anyway so rang Kodak and told them its faulty and i wanted a refund.

    They told me i had to send it back at my expence even tho its faulty for a refund.

    The Email arrived with my RMA number and says "Type of return: Customer changed mind (CCM)" even tho its faulty !

    Now heres where i becomes complicated, it seems the website is registered in the UK, the online shop part registered in Switzerland but has a GB VAT No , the camera was sent from Germany and thats where i need to return it to which will cost around £12 or so via Royal Mail fully insured and tracked.

    I asked to speak to a supervisor but they never phoned back.

    Heres the info on the kodak site i found out

    Im probally screwed and will have to take it on the chin as a learning experience !

    Not an easy one.

    I think I would write to Julian Baust at their Hemel Hempstead office and ask them to get involved.

    If oyu paid by credit card and the camera was over £100 you could throw it into their court and get them involved.

    Thanks, just checked the receipt and it has a GB VAT Number on it, wonder if that means I'm covered by UK consumer law.

    The camera was £95 so typically just under the £100 threshold !

    They certainly want you to think you are dealing with a UK company. They seem to operate in the UK and use the EU address for shipping only. You've got a good case.

    What a mess there t+c's are, the last paragraph seems like ive got a case, will ring the UK office in the morning

    "Payment for products purchased on the site shall be made to the operator of the KODAK Online Shop which is a Swiss company named Eastman KODAK SA. Any sale will therefore constitute an international transaction and as a consequence please note that your bank or credit card company may levy a charge for processing such a payment."

    They say that they are "governed by and construed in accordance with the laws of England and the parties irrevocably submit to the exclusive jurisdiction of the English Courts." Therefore you should be OK, as the goods are faulty.

    There should be no charge for you to return it as it is faulty, the following is from the BERR site Q 4; -

    The business is not entitled to charge for recovery of the goods if the consumer also has a statutory right to cancel the contract under other legislation, (for example because they are defective)..........

  • Hi,

    I bought a pair of remote controlled helicopters for my boyfriend's birthday. We were both flying them, and I crashed mine a couple of times as the were hard to control, and the top propeller blade broke.

    As I bought them online, I emailed the company and explained the situation, said that I didnt think it was acceptable that it broke that soon (hadnt even been using them for 5 minutes!) and asked them to replace either the whole helicopter or the broken part.

    They say that as I crashed the helicopter that I am responsible for paying for the new part - I honestly dont see how this can be the case? It even says on their website 'it's crash engineered construction means it can take a few wipe outs while you master the controls', I only crashed the heli twice and that was only into the sofa which isnt exactly hard or anything!

    Where do I stand on this? Id really appreciate any advice you can give.
