  • I ordered Virtua Tennis 3 on Ps3 from ASDA online there were two versions, original (£12.93) and platinum (£12.43). I ordered the original and all email confirmations said this but when the item arrived it was the platinum and the invoice said platinum but with £12.93 price. When I complained they didn't seem to care and told me to return it and they would send otu the original game. They then changed the website so both games had same price. When I returned the game it took a week for them to reply saying they were working hard to sort out the problem, I then got another email saying the order had been sent.

    No big surprise they sent another platinum version, I contacted them and now they say that if they don't have the game they just send the nearest version, this seems wrong as it was essentially a different game, by that logic they could send an xbox version or a totally different game, now they say they will just refund the money, they sent me the cheaper game twice and they didn't have the game they sold me, is there anything I can do? Any help is greatly appreciated. Sorry if this is in the wrong section.

    If they have already offered you a refund they appear to have dealt with your problem. They can't supply a game they say they don't have.

    It's ok for them to sell me a game they don't have though, then send me a cheaper one. Thanks
  • I bought a bike on the internet and just under a year later a component broke. The retailer tells me he is having no luck pursuing the manufacturer and suggests I take it up with manufacturer myself. I think the manufacturer is now making a newer model. Isn't it up to the retailer to sort this out?

    Yes, you contract is with the retailer. Point out that under the Sale of Goods Act he is responsible and if he fails to deal with your problem you will go to the Small Claims Court.

    I'm after some advice about a dead Dell Laptop.

    It's 25 months old and has just died - Dell say it's the motherboard and want £163 to fix it - which to be honest wasn't as much as I thought they were going to say - but it's still £163 more than I wanted to pay.

    How long should a laptop last and is it worth trying the "fit for purpose" and "reasonable length of time" routes with Dell? If so what and where do I write?

    FYI - the laptop has had no other problems in the past so has not been back to Dell before. It's also been treated very well n the last 2 years - not that I suspect this counts for much!

    Thanks in advance for any help and advice

    After 2 years you will have to prove there is an inherent problem with the laptop to get anywhere with Dell and that could cost you as much as they are asking for it to be repaired.

    The best you can do is speak to them nicely and ask if they will meet you part way on the cost.

  • Bought a LCD TV from Empire Direct Last November. The first one went wrong within two weeks. This was replaced. The second one went wrong within two hours. This was replaced at the end of January. The third one developed a fault in August. This was taken away by the manufacturers repair agent for a new screen but couldn't replace it as they are not made any more. This model of TV apppeared and disappeared inside six months!

    Empire Direct will give me another TV but they don't stockthe one that I want or one of comparable spec. I would like a refund so I can by a TV that I want. Empire say they will not give refunds.

    Do they have to give me a refund? If they are playing hardball can I get the refund by going through section 75 with my credit card company?

    Under the circumstances you describe you are entitled to a refund.

    Write to them pointing out that there is an inherent fault with this model and under the Sale of Goods Act you are entitled to a refund. Tell them you will go to the Small Claims Court if they refuse. If you used a credit card notify your card company that they are equally liable and ask them to assist you.

  • Hi there.

    Just bought a cot bed from Mothercare.com for use at my Mother's house, however after assembling it they've noticed that it's got some coloured paint on one side. Pretty noticible as it's a white cotbed. Having looked at the back of the delivery receipt Mothercare they will only accept the faulty item returned if it is with the original packaging, trouble is my parents put the packaging out for the recycling man as they have to rip the boxes up to get the bed out.

    I haven't phoned Mothercare yet as they are closed but if they get funny about replacing the faulty side as I don't have the original boxes do I still have my rights as the goods are faulty?
