No problem, get it replaced and give them the packaging from the replacement if they really insist.

Apologies, I thought you bought from a shop and not on line. They cannot insist on the original packaging anyway. Imagine having to return something after say 6 months - would anyone have the original packaging?
Speak to them and ask for a replacement pointing out the packaging has been destroyed but that you will return the goods in a safe condition to them.

Hi, I am hoping someone can help me....
I bought some dining chairs about 10 days ago in store. delivery is not due until this friday.
I now want to cancel my order (admittedly, I have had a change of heart and no longer want the chairs), and went into the store today to cancel. They told me that I could not cancel the order as the terms and conditions state that I only have 2 days to cancel. I suggested a credit note or vouchers instead, but they are refusing to budge.
What should I do - just accept the chairs no matter what??!? Can someone please tell me what my rights are in this?

Your rights are that you will be the proud owner of some chairs on Friday. You cannot simply change your mind. You entered a contract with the shop and they can hold you to it.

Hi,
Im not very good at being succinct.... so here goes!
Fujitsu siemens laptop bought at Comet on 13th September.
Last fFriday it crashed, cant read disk error wont book even into safemode.
Comet said i had to ring fujitsu first.... I wanted them to call my daughter to talk her through the fault diagnosis, they refused saying they are only a call IN centre. (It belongs to my student daughter who is foreign student with pay as you go mobile, and Im in Greece!)They have an 0870 number! Not impressed . :mad: So I have been trying to sort this. Finally she was sent to a comet a few miles away The nearest! where they did at least let her call Fujitsu but then was told that she had to download from the internet their system diagnostics tool on a cd, to try and boot from cd.( how without a functioning computer?
They agreed to post a disc to comet. (one of her flat mates tried to help by downloading the diagnostics tool but doesnt have a cd programme on his pc and its an image file that has to be burnt not just copied files... apparently? I gather that shop anf Fujitsu both believe its a duff hard drive. I understand that the problem must be diagnosed before we can go to the next step; meanwhile my daughter has lost her work and is without a laptop which she needs for her course. OK if its not the hard drive I accept i will probably have to let them repair it. If it is the hard drive can we insist they replace or refund? I will have no confidence in theis machine after this thats for sure.

On a laptop that is so new you have not been helped at all by Comet.
The responsibility is Comet's and not Fujitsu's.
Write to the store you bought it from with a copy to their head office, both recorded delivery. Tell them that under the Sale of Goods Act you are rejecting the goods as not being fit for purpose and you want a refund/replacement/repair (that's up to you). Inform them if the matter isn't dealt with in the next 10 days you will go to the Small Claims Court.
If you paid by credit card copy your card company in on the correspondence informing them that they are equally liable.

Thanks, but I feel I have to wait to confirm that the HD is duff first, with the diagnostics tool otherwise surely I can only ask for repair? There is a slim possibility it is a Microsoft problem/Vista/compatibility problem in which case I dont know where I stand? (I hate Vista!)
If its is the HD I do want a replacement. I will never feel confident that its not going to crash again and leave my, not very computer literate, daughter high and dry again.0 -
Hi All,
On 4th of this month I bought some shoes from a high street shoe shop, Two pairs for £50.
Now less than a month one of the pairs has developed a fault on the heal (It's Caving in) So I took them back to the shop today with my Receipt and the Supervisor refused to Either exchange or refund saying that I was probably heavy on my feet I said to her that it was my legal right for a refund, She said I should get them Re-Heeled I said Why it's not my fault why should I have to pay? She said she could send them off to head office I said that was not acceptable so she said I should come in tomorrow and speak to the manager.
Now do I have a legal right to have a refund or exchange?
If I do have the right; what do I exacly say of even print off to show the manager?
barrats is the shoe shop.
Oh and I paid by Visa Debit and it's within 30 Days.

Sorry if this is not posted in the correct section...
I bought a new Sony tv last night from the sony centre and i am not happy with it,there is a problem on it where it has clouding on the screen(white patches)in the dark scenes so im not happy,am i entitiled to get a full refund on this?thanks
