    For an inexpensive item there is little you can do except keep on at them and hope they eventually sort the problem out for you. It's not worth going to court on this one. Sorry.

    hi all

    i bought some shoes from Schuh around a month ago and within two weeks one of them started squeaking really badly - from what i can make out the sole has split so everytime i walk it results in a terrible squeaking noise.

    What are my rights in asking for a refund or replacement? Ive never really had to return shoes before especially used ones! So I'd be grateful to know what i can and can't do before i go back to the store?

    Go back to the shop and tell them the shoes are not of merchantable quality and you want a refund or replacement. You are within your rights under the sale of Goods Act.

    Hi as newbie please excuse this question
    I trained as a DEA with a company who promised to repay training costs after one years service if I used their training company.
    I paid by visa Lloyds TSB and then paid off my card as usual unfortunatly the company went into liquidation in december after only 5 months work, as I had passed the 3 months probationary service I wrote to the administrators reqesting payment of my training costs "obviously they have no money to pay" so I contated my card company who are saying that my training was complete so no liability under section 75.
    However I think they do have a liability as the advert that led to my decision to choose this company clearly stated money back after a qualifiying period and so did my contract of employment.
    I would apreciate any advise on my next move

    This is a difficult one. Llloyds TSB are technically correct, you have had your service. Contact them again and push your point that the moneyback guarantee was part of the deal and it has not been met.

    Thanks for this. It worked, eventually. At first they claimed they couldn't take it back it had been "used" and they could not resell it as new. I found an OFT leaflet for online retailers regarding DSRs and there is a specific bit in that states that the fact that the retailer cannot resell as new (say for hygiene reasons) does not affect the consumers rights to inspect, trial, and return goods under DSRs. It is OFT leaflet 698. As soon as I quoted that and the leaflet number they offered me a full refund/exchange.

    I wonder if someone can help??

    My girlfriend bought a dress from Reiss for £165.

    It was this one:

    She wore it only once.

    There are two problems.

    The 'interface' around the neckline, which connects the heavy outer material to the light lining seems non existent, so when she wore it the outer lining kept weighing the dress down so the lining was appearing around the neck. This was really annoying for her, especially when she paid so much for it.

    To add to the problems, it rained.

    When she looked at the dress when she got in, it had watermarks all over it. i.e. you could see all the mark from the raindrops all over the dress from top to bottom.

    We arranged to take it back to the shop, but stopped off at Johnsons the Cleaners first to possibly get the marks removed as we thought this would be the easiest problem to resolve... except it wasn't.

    They told us they could do a silk spray clean, but it has risks!! 1. the material could change colour, 2. it could shrink.

    So we said we'd leave it and go to the shop.

    We went to the shop and explained the issue and they said that they don't deal with problems, they send the dress to Head Office. So we said OK.

    Yesterday we received a letter from Reiss stating that there was no manufacturing fault with the dress, and could we email them an address to send it back to us!

    So we have a £165 dress, with a strange neckline, and water marks all over it. We can do nothing to the neck and there is a real possibility of totaly ruining the dress should we get it cleaned.

    Any ideas what rights we have?

    What can we do?

    Write to the supplier and reject the goods for the reasons you have stated and ask for your money back. If you paid by credit card write also to your card company telling them you hold them liable also.

    I bought my daughter a Nintendo DS from Argos in January and it has stopped working, when you try and switch it on it doesn't switch on and when you put it on charge then it goes red and instantly goes off again (the wee light)

    I have the receipt and will take it back tomorrow with the box and manual etc, what should happen from here? Anything i should be forewarned about?

    Argos will possibly tell you to contact the manufacturer. Don't do this. Argos are responsible to sort out your problem. Under the Sale of Goods Act you are entitled to a replacement or a refund. From past experience you may have to battle with them to get them to deal with this. A letter to their head office may be necessary.
