Vodafone change T&C's (Call charges) - Possible contract get-out??

Thank you for your email dated 12th August 2008, addressed to Arun Sarin, our former Chief Executive, regarding the increase in minimum call charge.
I understand that you are concerned about proposed price increases, which are scheduled to become effective from the 1st September 2008.
With regard to the increases I would advise that Vodafone have not revised their prices for over two years, and are not the only operator to do this. Regulatory pressures/ interconnection costs have had an influence on Vodafone’s decision.
The increase relates to the minimum call rate and non-geographic numbers (0870, 0845, etc). Although you refer to the contract clause about a 10% increase, this actually relates to an overall increase in call costs and is not limited to certain call types.
Having reviewed your invoices, it seems that most of your calls are included within your call allowance and there are very few calls listed to non-geographic numbers. It therefore seems unlikely that your overall call usage would increase by more than 10%, based upon your previous call or usage pattern.
I do hope that the above clarifies the situation and apologies once again for any misunderstanding that has arisen. However, if you should have any further queries relating to this matter, please do not hesitate to contact me.

8) Ending of this Agreement
a) You may end this Agreement immediately by writing to us if:-

o all of the Services are permanently no longer available to you;
o we increase the monthly (or other periodic line rental charge under clause 7a) and such increase (calculated as a percentage) is more than the increase in the Retail Prices Index Figure ("RPI", also calculated as a percentage) for the period from the month of the last increase (if any) to the month before we send the notice of the change in tariffs and you write to us before the increase takes effect. If we increase the monthly (or other periodic) line rental charge by more than the increase in the RPI we will tell you; or during the term.
In particular, this section…
we increase the monthly (or other periodic line rental charge under clause 7a) and such increase (calculated as a percentage) is more than the increase in the Retail Prices Index Figure ("RPI", also calculated as a percentage) for the period from the month of the last increase (if any) to the month before we send the notice of the change in tariffs and you write to us before the increase takes effect. Now, looking at the proposed prices…
1. Minimum Call Charge
Increase from 5p to 15p = 200%
2. Out of Bundle Rates
Increase from 10p to 15p = 50%
3. Non-Geographic Rates
Increase from 15p to 20p = 33% Increase
The current RPI is 4.6%, and as you can see, you will be increasing more than this, which relates to the clause in the contract as quoted above.
As this is way above the RPI and what I would deem as acceptable, I would therefore like you to cancel my Vodafone contract as of the 1st September 2008 using clause 8a within your own Terms & Conditions of the contract between us.
This should not incur any costs to myself, as this is a breach of contract by you as a company.
I definitely use both the non-geographic numbers and out of bundle calls on a regular basis and I do not believe these increases will be of any benefit to me.
Please reply with confirmation of acceptance of the termination of my contract.

So I read into her reply if i spend 10% more on 08 numbers in Sept, Im a vodafone FREE ? or do you think i should carry on pestering them. If so anyone got some advice?

Vodafone have told me today :
The phone is a gift and the airtime and network access and calls are what the contract is for
They have asked for the call back and have now got it. I have requested confirmation regarding this- as the phone should be a 'free gift' as they have informed me.
They have required me to return a 'free gift' to terminate the contract.
So one person has told me that the phone should be sent back, and another has told me that the phone should be retained by them
Will have to wait until Monday until the boss of the guy I have had is back and apparently his decision is finalbaldly going on...0 -

Ive never been out of my contract. My argument was how do I know what my future use would be?
The manage seemed very eager to please. Saying he could look at my history of bills etc etc but what was the point of !!!!ing off a customer, and he would just do what I asked.
Unfortunately not sure of the managers name, I am sorry. But if people want a copy of the letter I sent I would be happy to send them a copy.0
