    Personally I think it's fine and I would add any evidence of arrears that you have, maybe ask the landlord to email you the fact that you are in arrears....

    Hi All

    To cut a long story a little short....

    I initially put in my claim for financial hardship in sept 08 and after sending in all the required paperwork they have finally written and basically said

    " following a review of your income and expenditure details it has been established that you are facing financial difficulties though we do not accept that the charges incurred are the cause of your financial difficulty "
    I find this really difficult to understand and am unsure of what the next step would be? I originally banked with first direct and had a personal loan with ppi that i was struggling to pay so over the phone they offered to close that loan and consolidate my credit card and the loan together which i slightly foolishly agreed to at the time as the interest rate on the first loan was 7% and the new loan was 11.6%. I didn't actually ever get anything in writing to confirm what the redemption figure on the 1st loan was they just popped me on hold and came back with a figure i needed to have to consolidate??

    I made the 1st 6 months payments with no problems until being made redundant last year and they would not reduce the payments and the loan and overdraft are now with debt collection agencies which i have payment plans set up with. during the time between my account being passed to the agencies I accumulated nearly £1500 in charges :mad:

    most of my current financial problems started at exactly the same time as me incurring all the charges so i don't really understand how they can say the charges incurred are not relevant to my hardship claim.

    I must admit to not be a financial whiz at all and have tried to follow the advice and this amazing website but I am now a little lost!!

    any help or advice would be very gratefully received

    Hi,
    I was recently moved from Income support to carer allowance benefit. Because of that i can no longer apply for grants to help my son who has a severe autism and learning disability. I recently got him a one on one tutor to work with him at home for 2 hours a week at £25 p/hour. My son had improved on his communication (by signing) and some of his social interaction that it is not an option to stop his sessions. The HSBC also had been charging me while i was in Income Support 6 years ago. Is that another reason to reclaim my bank charges?
    Also,the housing also recently stopped my housing benefit and still awaiting the outcome of my appeal to the council. I now owe the Private Sector Leasing over a thousand pounds of rent arrears.
    Can anyone help me please how to go on applying bank charges if the above is considered a financial hardship?

    I am a newbie here but I am in dispute with the Bank of Scotland. They owe me about £6k and have me on hold - but they are taking about £600 per month in charges since December. I have asked them to consider financial hardship as I am having difficulties meeting my commitments - credit cards/loans. However, they have not even acknowledged my letter. I have tried the Ombudsman by email but I have had no response from him either.

    I am trying to find a new bank but am concerned at what the BoS will do with my overdraft which is far exceeded by what they owe me. Does any one have any suggestions.

    The BoS is deliberately manipulating the payment of direct debits to ensure that I never get out of the charges.

    Does anyone have any suggestions to help.
  • Can anyone advise me please. My RBS account is closed. I wrote to RBS claiming hardship and requesting bank charges be repaid under hardship terms. They supplied copy statements and I complied a list of itemised charges which I provided them with 8 days ago. (My partner and I have severe financial difficulties and have arrangements and arrears with all of our credit cards, mortgage company etc). I have yet to hear anything more about the claim, but yesterday, I received a letter from a recoveries company called Irwin Mitchell in Manchester claiming repayment of my total RBs 'debt' within 14 days or they will take action in the courts to recover £4317.69 (over half of this sum is made up of the charges I am claiming back) also seeking a money judgement and or Charging Order against the house. )I have alredy explained in writing to RBS that we have negative equity of about £80,000). What to do next?

    We are in a very similar situation. Confirmed our hardship and told us they will not pay out until after the court case! we have sent a letter to the FOS now.

    You need to start a claim and complete an income and expenditure.You need to put this down in writing. Explain how the problem began and the reasons why you did not have sufficient funds to cover priority debt arrears and how the charges affected your ability to pay. Furthermore, explain you family circumstances and that the tutor is essential and is having a major impact on your child who is autistic.
    And finally, keep us updated on how you get on.

    how come you are still being charged £600.00 a month. Have you cancelled Direct Debits and ask the providers to send out paper bills to pay?

    Direct debit providers ask for the funds and the bank merely decide whether to pay or return the item. Manipulation simply is not possible since they do not request payments unless it is to themselves ie loan/mortgage/credit card.
    Does anyone have any suggestions to help.

    Well, I decided to take the plunge and yesterday morning sent a letter first class recorded delivery to halifax claiming 1200 of charges. This evening I have got in the house and have been amazed to find 3 voice mails from halifax asking me to call them about it (!) This has got to eitrher be a very good sign or a very bad one!
