Firstly an update on last weeks post.... my father had an offer today for one of his accounts.... we were claiming £2100 on the account and the offer is £315.
So my questions now are:
1- Do you think this is a fair offer? how much is his priority debt arrears?
2- What happens if my Father refuses the amount- can he ask for more? Is there a time limit on the bank replying with their final decision if he does not accept this offer? He can ask for more based on Priority debt arrears, the bank can decline and if he doesn't accept it then he either goes to the FOS who may agree or disagree with the bank or file a claim at court that will be stayed pending the conclusion of the OFT test case.
3- Is this amount in full and final for that account or is it a part payment whilst he is in financial hardship? It cannot be offered in full and final settlement of the claim
4- By offering a sum of money are the bank confirming he is in financial hardship as they have not confirmed anything in writing other than the offer? The offer itself is confirmation that they consider him to be in financial hardship and the money is offered to ease that hardship.
He is now unsure what to do and to be honest as he needs the money hes not thinking straight. My worry is that if he accepts this amount on this account the bank may then base the other accounts on the same ratio or even less. As his total claim is many thousands he would be getting back approx 1/7th of his original claim (which we didnt include interest on).
It is ultimately his decision but hopefully the extra info will help him make he decision that is right for him.0 -

Hi I did the same thing with Halifax, they have denied me any bank charges back till the end of the court case but are asking me to pay £5 a month to repay my overdraft...
If you have any success to get charges back please can you let me know what you did. as they have agreed im in hardship but no way will they be giving me my charges back yet.. Thanks0 -

we bank with the A&L and have bank charges of £3000 pounds.
we have sent the letters and income expenditure forms to the bank but they never replied until today(sent on the 1st of june 09)which they now say we didnt send in a form and are giving us 14 days to do so???!!
we phoned them last week and were told that because i was working that i should count myself lucky that i have a wage coming in as others that are claiming dont have!
this i can understand but as my wife has lost her job and is staying at home to mind our two children it has left us with more money going out than coming in
we live in a private rented house(£140 per week rent) and have been put on the hse waiting list(approx 3 years) as we are not considered a priority but with my wife loosing her job in february we have not been able to pay our landlord for 16 weeks now.
he has phoned me today and has told me that if i dont pay the rent up to date by the end of june he will remove us from our house!!
can anybody tell us what our next step is??0 -

yes, firstly tomorrow call the bank and ask for an address to send the letter, furthermore, ask your landlord to put it in writing and explain that you are going through the bank on financial hardship grounds and they require proof.
When you call A&L explain that as a direct result of the charges and loss of income you are under the threat of being made homeless which you are getting proof of.
Did you send the documents recorded delivery? If not then make sure the next ones are. Furthermore, under financial hardship, you need to argue how you got into trouble since bank charges are the consequence of a lack of money. Then explain that your claim is £xx.xx which you would need to ask for £xx.xx amount to stave off the loss of your home, arrears on utilities, council tax, and furthermore to at least bring the account under the overdraft amount to allow you time to straighten out your financial hardship. Are there any benefits you can get to help you in the short term?0 -
we got the staff member in the branch to sign a reciept for the letter on 1st of june. In this we used the template letter from this site and sent a photo copy of the income expenditure form along with a list of all the charges and the possible interest.
my main problem is that my landlord gets paid cash for rent and that i think he is not putting it through and probably wouldnt want the bank or anybody to know this!
in the conversation we had with the bank they also told me that i couldnt be too badly off as i am paying for sky tv but where i live(at the bottom of a mountain) this is the only form of ariel that we can get tv with.
i also explained this to them and that i had already cancelled direct debits to help ease my situation but0 -

we do recieve benefits in the form of working tax credits and child tax credits and the wife has an appointment with the jobs and benefits office next week.
but i thought the bank was not allowed to implement charges when you get benefits?? but they did so last week when we were charged two £25 charges.0 -
