I wrote to Barclays trying to claim back over £5k in charges stating and proving hardship. They will not pay anything until the results of test case and even then they say they will not refund all the charges. Good old Barclays (the sole cause of my financial downfall in the first place). Anyone know of a worse Bank? Answers on a dust particle please.0

I have claimed back charges off RBS, under the financial hardship rules, And I am trying to claim them back of HALIFAX!!!,
any way getting down to it, i sent copys of statements ccj's rent arrears everything, along with the financial statement they asked me to complete. i sent them special delivery then i know that they received them, this was about 8 weeks ago, i received a letter today explaining that my financial statement does not tally up with my claims that i am in financial hardship.
and i need to send proof of arrears/statements etc. (BUT I ALREADY SENT THESE) and have proof they received them. so i rang them and challenged them with it. and they said there was no more they could do unless i sent proof.
SO FRUSTRATING.
CAN ANY ONE HELP.

I have recently claimed charges against the Halifax who have so far not paid back anything. I have used the template for a standard letter asking that my charges as well as any other charges be paid back in full. I only issued what the bank had charged me recently and not bothered to go back the six years. However after a letter sent to them threatening court action i have receieved a Mat/BBA Common Financial Statement. Because i have now received this letter and the form above to fill in i am now going to send in a form asking the bank to provide me with all charges made against me in the last six years.I am a little confused at the moment as to the next step have i got to fill this statement in and send that before taking any action against the bank or should i continue with taking this to my local claims court.I have cancelled all Direct Debits with the bank and i am trying to sort these out best way i can. I have so far struggled to keep ontop of all this without incurring any charges with other institutions. However because the money i put in the bank to pay my Halifax loan was taken to pay charges this meant that my loan never got paid. So the Halifax had rang me to state this money had not been paid i had to pull this amount out again leaving me with no money. They have even had the cheek to now state they are going to charge me £10.00 for a telephone call and a Default charge of £20.00 even though i paid this missed payment. The Halifax are going to start charging shortly on all my charges still unpaid. I am putting no money in the bank as this is being swallowed. What do i do about this Financial statement have i got to fill this out before pursuing the next course of action.Thankyou in advance
Complete the statement first. Send a copy to Halifax, recorded delivery. If you wish to pursue this through the courts/FOS you can do so. Have you received a final reply from Halifax? You need to have received this first, before you can go to the FOS. Or try the hardship route. Download a hardship template from this website. You'll have to prove you have priority debts.
Note: you should have requested your statements/summary of charges, in the first instance. you have to allow 40 days for the bank to send them and pay 10 pounds.0 -

Ring them and state you will go into a branch and get them to fax it and the branch can send copies internally and ask them where the branch needs to send it to?0 -

Hi, as well as using a template letter, try doing another and editing it a little to suit your situation, highlight important things that also qualify you for financial hardship IE overdraft made up of solely their charges, rent/mortgage arrears etc etc,
include ALL copies from any debts, benefit, and most importantly an income and expenditure sheet so they can see that you are left with little or nothing.
Also state that you require a clear decision on your application for financial hardship as they are very sneaky and skirt around the issue, by stating that your account hasnt been compromised by hardship(as in my case)
Make sure you send this letter by recorded delivery and keep copies, send it to.

Tell the person on the other end that you wish to go through your application for financial harship and that she could make the decision and log it onto the account notes for all to see.

I had a letter back dated 2nd June advising they are basically doing nothing about it except for advising somebody would be in contact within a week to review my finances (which incidentally tey have failed to do!!!)
Any suggestions where to go from here????Thriftkitten

Don't wait for one of their Income and expenditure sheets to arrive, everything is available to print on this site, and also another great site is Legal Beagles(Free too)
If you dont have a printer, pop into the library, you can use the computer free for an hour there and also print for about 10p per copy.
Lloyds are difficult and you just have to keep badgering them and you'll get ther in the end.I requested an income and expeniture form from lloyds last week and the reply was to wait till the courts had made a decision. I have sent letters of arrears,court summons for council tax etc to lloyds and their response was that one of their team would be in contact with us (they did' nt)Are you still with lloyds ?Thriftkitten

They did the exact same thing with me, I then called Andover, went through my financial hardship with the lady on the phone and she made the decision that I was in financial hardship, she logged it on my notes, gave me payplans number(which I didnt call) and then I sent another letter again to Andover stating that I had been accepted for financial hardship and that again I was making a request to pay back full amount, got fobbed off again, so sent one of the templates for a speedy settlement within 14 days, minus any interest( just the charges) and that if they did not agree I would take it to the court for the full amount plus court fees, Hey presto... they debited my account with in 2 days!!! for the full amount minus interest!! Dont give up!
