I have had a case going through with Abbey, and despite having filled out all the forms and also having a Debt Management Plan with the CCCS, they have rejected my claim on the basis that my Income is more than my expenditure! Even though i meet most of the criteria set by the FSA...Any ideas how to proceed?!!

Does this also apply to businesses in financial hardship
My girlfriend set up here business a couple of years ago, and as any business was always in her overdraft to get it started. Then she slowly started making a profit for a couple of months, credit crunch and all that is now making a bigger and bigger loss.
Abbey took charges after charges out and have refused to pay it back.
She now is struggling to pay the monthly rental on her shop and scrapping enough even to get the business council tax together.
Can Abbey refuse as they have done 3 times.

I have submitted a claim to Natwest re financial hardship as i am out of work and my husband lost his job in September, i am WELL over drawn and we now have a DMP in place with the CCCS, if my claim was successful what would Natwest do? Do they insist that it goes onto my overdraft of will they send me a cheque as my account in inactive and there are only DMP payment going into the account.

Did you send by registered post because lloyds:mad: LOST my letter requesting a list of charges in March 2009 .I send all letters to lloyds this way now,at least they can 't deny they 've not recieved any letters. Good Luck.
I would definately send all by registered post, as Abbey have quite convienently not received 2 letters not posted by registered post. Call me paranoid, but they are lying. Imo Abbey are the only ones to have been really offish about all this, even when they finally got the letters from my girlfriend.0 -

I was recently made redundant and used the template letter to continue with my claim from Lloyds TSB under financial hardship.
I had a letter back dated 2nd June advising they are basically doing nothing about it except for advising somebody would be in contact within a week to review my finances (which incidentally tey have failed to do!!!)
Any suggestions where to go from here????0 -
hello everyone.ive been trying to claim back my bank charges under financial hardship since may ive sent 3 forms proof of my debts as thay kept saying thay had lost my forms ect.more like fobbing me off.anyway i got a letter this morning saying.thay have reviewed my account carefully and thay are satisfied that the fees were correctly applied.and that my complaint about my bank charges will remain on hold pending the outcome of the ongoing legal proceedings with the OFT.and thay would like to arrange for there specialist money management team to contact me.so im a bit confused.com on what i should do next.please could someone give me some advice.

I think we are all being fobbed off with the impending court case, I received a goodwill gesture of from Halifax - but this went straight into my overdrawn account and couldn't be used for any priority debts - I also got the letter saying they had reviewed my account carefully and they are satisfied that the fees were correctly applied.and that my complaint about my bank charges will remain on hold.
I am now being hounded by their collections team for £1200 owed to them this is on top of my £2,000 overdraft - they too want me to speak to their money management team.
When I called Halifax about the rest of my claim they said that I had already accepted an offer - I made them aware from my previous letters that this was merely a partial payment and not full and final settlement.
I have now taken my case to the Ombudsman who are now in contact with Halifax - meantime they too are issuing me with default notices - ruining my chances for future credit.
It disgusts me how the bank can treat us in this manner, they were quick to take the charges but not to return them.0 -

Hi all i'm a newbie on here, and the hardship cases however have had many successes on the bank charges front for myself and family/friends.
I'm currently dealing with RBS with bank charges. After having my case put on hold, i started on maternity pay, which changed my finanicial situation grately. I found out about the hardship rule through this amazing site and thought hey ho they can only say no
I had to supply them with loads of information, which they gave little time to supply however i hit their time limits (even though they fail to hit mine constantly)
Well after waiting anxiously for the postie every day. Today it came.
A letter stating they confirm i'm in hardship, demanding i cut my cards up and send them back. When and only when i have done this will they send me a letter with an offer in.
any advise here would be great0
