  • HEY PEOPLE,

    Iv just relised in the past few weeks that i can reclaim my bank charges which im quite please with because since february this year iv had over 200 pound taken from my account because of being a few pound over drawn each time or beacause my direct debit has bounced.Even tho im on a job seekers allowance and every time i get a charge i have no money to live on for two weeks as i have to pay digs and food bills. So iv cancled all my direct debits and taken it in to my hands to send a letter to the bank asking for a list of all the default charges for direct debit, unauthorised overdrafts and standing orders I have paid since the 3rd of april 2004.I got the template from here so fingers crossd will be sending it of tomorrow.

    QUESTION:
    Do i just send the letter to my local bank ? Or does it need to go higher ?

    Anyways im new so if anyone can assist me id be greatful as im not to good at this kind of thing :confused: Lol..

    I owe my electricity comopany an absolute fortune but never stated this on my claim form. I have sent in about 6 or 7 letters showing my debts. I still bank with them but only have a basic account and they wrote to me on Monday offering me £35,which i will not be accepting!!how long will it take the financial ombudsman to come to a decision?

    Do you have priority debt arrears(mortgage/rent/council tax, utilities)? If yes, did you make any arrangements to pay off the arrears?
    Do you still bank with them?
    Did you send any notice of arrears to them?
    Are you aware that any offer is not made in full and final settlement of the account?
    Did you claim back to July 2001?

    You need to be aware the you shouldn't expect a payout because the bank does not have to pay out even 1p under financial hardsip. However, I would negotiate based on priority debt arrears against the amount offered.
    Furthermore, the FOS won't necessarily change the offer to anything higher.

    I applied under hardship rules to halifax for over 3,000k... they have offered me 75quid and three months of no bank charges what do i do next? should i take it up with the fininancial ombudsman?

    They are tough nuts to crack so I do wish you luck. Did they send you an income and expenditure form to complete?
    I requested a form 2 weeks ago and have not recieved one yet
  • I have been trying to claim chares for ages, now gone the hardship route. Got rejected but have now appealed. I am currently working with payplan to get my life in order I have filled in a i&e form sent in loads letters from my mortage company bank, loans etc. Sent it to address 100 west george st, glasgow. They say my account has been passed to cms part of natwest and will forward my docs . They got lost and many phone calls later have been found. They are currently looking into my case. They say they will look into my case today and get back to me

    Natwest seem to be dragging there heals, has anyone had success with them ?

    Does anyone have an idea of when this court case may be resolved?! How long does it take really to see that we are being robbed and the charges are NOT justified for the amount of work it causes them??!

    !!!!!!(apologies), You need to go back to the bank and make them aware that you made an error with your income and expenditure form and didn't include electricity arrears.

    I would say you should accept as an interim but make them aware of the error you made on electricity arrears cos they are not mystic meg and it makes your situation worse that it looked previously. I'm not advising on the FOS on this one just yet cos the bank still don't have information that could make the payment higher for you.

    You are looking at the consequence of authorising payments to companies without the capacity to fullfil your part of the bargain. I wouldn't call it robbing but it can be levied both ways. The charges for your failure is not theft, but it is, in my opinion, unfair.
    When is the conclusion???? Have you got a ball of string yet? This is the preliminary Issues stage.

    I have been charged arrears fee by my mortgage company for the past 6 months (£55 per month) as I was more than 3 months in arrears each month

    Do I have grounds to get them back under the bank charges reclaiming case or are mortgage companies seperate?

    I thought that as they are a bank they might fall under the current case but I am not sure

    Can anyone advise?

    I have recently claimed charges against the Halifax who have so far not paid back anything. I have used the template for a standard letter asking that my charges as well as any other charges be paid back in full. I only issued what the bank had charged me recently and not bothered to go back the six years. However after a letter sent to them threatening court action i have receieved a Mat/BBA Common Financial Statement. Because i have now received this letter and the form above to fill in i am now going to send in a form asking the bank to provide me with all charges made against me in the last six years.I am a little confused at the moment as to the next step have i got to fill this statement in and send that before taking any action against the bank or should i continue with taking this to my local claims court.I have cancelled all Direct Debits with the bank and i am trying to sort these out best way i can. I have so far struggled to keep ontop of all this without incurring any charges with other institutions. However because the money i put in the bank to pay my Halifax loan was taken to pay charges this meant that my loan never got paid. So the Halifax had rang me to state this money had not been paid i had to pull this amount out again leaving me with no money. They have even had the cheek to now state they are going to charge me £10.00 for a telephone call and a Default charge of £20.00 even though i paid this missed payment. The Halifax are going to start charging shortly on all my charges still unpaid. I am putting no money in the bank as this is being swallowed. What do i do about this Financial statement have i got to fill this out before pursuing the next course of action.Thankyou in advance
